HomeMy WebLinkAbout7317 - ADMIN Resolution - City Council - 1983/01/17r RESOLUTION NO. 7317 A RESOLUTION AMENDING RESOLUTION NO. 7003 ADOPTED NOVEMBER 2, 1981 AMENDING RESOLUTION NO. 6770 ADOPTED FEBRUARY 2, 1981, AMENDING RESOLUTION NO. 5502 ADOPTED APRIL 19, 1976, GRANTING PERMIT UNDER SECTION 14-195 (6:176.2 AND 6:176.4) OF THE ST. LOUIS PARK ORDINANCE CODE TO PERMIT A RESIDENTIAL DEVELOPMENT UNIT AND COMMERCIAL DEVELOPMENT UNIT FOR PROPERTY LOCATED IN THE R-4, MULTIPLE FAMILY, AND B-2, GENERAL BUSINESS DISTRICT, IN LOU PARK ADDITION BE IT RESOLVED BY THE CITY COUNCIL of the City of St. Louis Park: Findings 1. Daniel Otten has made application to the City Council for a special permit under Section 14-195 (6:176.2 and 6:176.4) of the St. Louis Park Ordinance Code for the purpose of using the land in the B-2, General Business District, for a Commercial Development Unit, and in the R-4, Multiple Family District, for a Residential Development Unit for restaurant, hotel, and multiple family dwellings at the following location: All lots and blocks in Lou Park Addition 2. The City Council has considered the advice and recommendation of the Planning Commission (Case Nos. 75 -65 -SP, 81 -101 -SP,' and 82 -93 -SP) and the effect of the proposed use on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan. 3. The Council has determined that the proposed Commercial Development Unit and Residential Development Unit will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it serioiusly depreciate surrounding property values, and the proposed Commercial Development Unit and Residential Development Unit are in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special • permit to permit a Commercial Development Unit and Residential Development Unit at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The residential portion of the site shall not contain more than 418 residential units to be developed generally in accordance with Exhibit A, General Development Plan. 2. The final plat for Lou Park Addition shall be recorded in accordance with Section 14-303 (6:303-C-6) of the St. Louis Park Ordinance Code. 3. Before a building permit is issued for any construction on any lot or lots included in the plat, an amendment to this special permit which includes a detailed site and development plan for land to be included in such building permit mtrst be approved by the City. Such detailed site plans must conform to the General Site Plan, Exhibit A. 4. All electric, telephone, or other wire or cable distribution services, gas, sewer, and water services shall be placed underground. 5. That the General Site Plan, Exhibit A, , is hereby amended and superseded by the General Site Plan, Exhibit B, designating 236 units on Parcel C and 72 units on Parcel E and except that no parking reduction is authorized on Parcel C. 6. That the General Development Plan be amended to designate Parcel C, a residential site for 236 units, to office use with a maximum of up to 200,000 square feet in a nine story building and to permit construction of a free standing Class I Restaurant of 10,000 square feet on Parcel A, a site designated for a 200 unit hotel with a restaurant. 7. That the General Site Plan, Exhibit B, is hereby amended and superseded by the General Site Plan, Exhibit C, designating Parcel E for 132 units instead of 72 units as previously allowed.
