LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT PLACEMENT OF APPROXIMATELY 4,000 CUBIC YARDS OF FILL FOR PROPERTY LOCATED IN THE DDD, DIVERSIFIED DEVELOPMENT DISTRICT, AT 1625 ZARTHAN AVENUE SOUTH BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Honeywell, Inc. has made application to the City Council for a special permit under Section 14-113(7) of the St. Louis Park Ordinance Code for the purpose of placing approximately 4,000 cubic yards of fill located at 1625 Zarthan Avenue South for the legal description as follows, to -wit: That part of Government Lot 8 lying northeasterly of Cedar Lake Road except roads, Section 4, Township 117, Range 21; and that part of Government Lot 1 lying north of the centerline of Old County Road No. 16 except roads, Section 9, ,Township ,117, Range 21, in Hennepin County, Minnesota 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 82 -49 -SP) and the effect of the proposed placement of fill on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed placement of approximately 4,000 cubic yards of fill will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed placement of fill is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit placement of approximately 4,000 cubic yards of fill at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A, Plot Plan. 2. A landscaping plan for the berm shall be developed in consultation with City staff and approval sought by May 15, 1986. 3. Measures to minimize erosion of the berm shall be taken as long as the berm is unvegetated. Hay bales or filter material shall be located so that material washing off the berm will be contained. 4. Placement of fill, grading and seeding shall be completed by June 1, 1983.
