LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT A 120 BED NURSING HOME ON PROPERTY LOCATED IN THE R-4 DISTRICT, AT 4415 WEST 362 STREET BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Park Nursing and Convalescent Center, Inc. has made application to the City Council for a special permit under Section 14-141(3) of the St. Louis Park Ordinance Code for the purpose of splitting a lot and operating a 120 bed nursing home located at 4415 West 362 Street for the legal description as follows, to -wit: All that part of Lots 34 and 35, lying North of a line drawn Westerly at right angles to the East line of said Lot 35 at a point 348.10 feet South of the Northease corner of said Lot 35, Block 2, in Minikanda Vista Second Addition, subject to an easement for ingress and egress over the East 40 feet thereof. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case Nos. 80 -67 -SP and 82 -59 -SP) and the effect of the pro- posed lot split and nursing home on the health, safety and welfare of•the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan. 3. The Council has determined that the lot split and nursing home will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed lot split and nursing home are in harmony with the general purpose and intent of the Zoning Ordin- ance and the Comprehensive Plan. Conclusion The special permit to permit a 120 -bed nursing home at the location described is granted based on the findings set forth above and subject to the following conditions: 1) The site be developed, used and maintained in accordance with Exhibit A., Site Plan -Landscape Plan (except as modified by Exhibit A, dated July 28, 1980, and prepared by Cardarelle and Associates, Inc., splitting off that portion described as follows:) All that part of Lots 34 and 35, lying North of a line drawn Westerly at right angles to the East line of said Lot 35 at a point 348.10 feet South of the Northeast corner of said Lot 35, Block 2, in Minikanda Vista Second Addition, subject to an easement for ingress and egress over the East 40 feet thereof; Exhibit B, Elevation Plan; Exhibit C, First Floor Plan; Exhibit D, Second Floor Plan; Exhibit E, Room Detail; and Exhibit F, Trash Enclosure Plan; except as modified by the following conditions: A) All exisiting landscape ;eatures including trees, grass areas, benches, swing and the like shall be retained. The fountain bridge, trees and grass area, which must be removed for the addition, shall be relocated on the site, (or similar landscape features, and additional landscaping shall be provided as shown on the site plan as modified by the Planning Department June 15, 1973. 2) That a new trash enclosure be allowed subject to the following conditions: a. The site shall be developed, used and maintained in accordance with Exhibit G, Trash Enclosure Plan. b. All work shall be completed by October 15, 1982.
