HomeMy WebLinkAbout7210 - ADMIN Resolution - City Council - 1982/09/07RESOLUTION NO. 7210 A RESOLUTION GRANTING VARIANCE IN FRONT YARD SETBACK FROM SECTION 14-173(6) OF THE ORDINANCE CODE RELATING TO ZONING TO PERMIT A FRONT YARD SETBACK OF 15 FEET INSTEAD OF THE REQUIRED 20 FEET IN THE I-1, INDUSTRIAL DISTRICT, AT 7115 LAKE STREET WEST UNDER SPECIFIED CONDITIONS BE IT RESOLVED BY the City Council of the St. Louis Park, Minnesota: FINDINGS 1. Cardinal Insulated Glass Company has requested a variance from Section 14-173(6) of the Ordinance Code relating to zoning to permit a front yard setback of 15 feet instead of the required 20 feet for property located in the I-1, Industrial District, at the following location, to -wit: Lots 6 to 10 inclusive and Lots 22 to 33 inclusive except that part of said lots lying northerly of a line parallel with and distant 20 feet southerly of the center line of the main belt line track of the Milwaukee St. Louis, and Chicago, Milwaukee, St. Paul, and Pacific Railroads and except that part of Lots 27 to 33 inclusive lying westerly of a line described as commencing at a point in the northwesterly line of Lot 27 distant 30 feet easterly from the northwest corner thereof, thence southeasterly to a point in the northwesterly line of Lot 31 distant 59 feet northeasterly from the northwest corner thereof, thence southeasterly to a point in the northwesterly line of Lot 33 distant 66 feet northeasterly from the northwest corner thereof, thence southeasterly to a point in the northwesterly line of Lot 35 distant 61 feet northeasterly from the northwest corner thereof and there terminating. Also except the south 10 feet of the west 10 feet of that part of Lot 33 lying easterly of the last described line, all in Block 162, Rearrangement of St. Louis Park. 2. That certain agreement between Cardinal Insulated Glass Company (CIG) and the City of St. Louis Park, Minnesota (CITY) dated July 1, 1982, executed in settlement of outstanding litigation between the aforementioned parties, contained a provision whereby the CITY agreed to grant a variance to CIG to allow the construction of an office addition to CIG's premises. 3. The CITY makes no representations concerning effects, either positive or negative, of the variance on health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, damage of fire, risk to the public safety, effect on property values in the surrounding area and the effect on the Comprehensive Plan. 4. The City assumes no liability for adverse consequences which might be attributable to granting of the variance. 5. The granting of the variance is necessary in order to satisfy the terms of the above-mentioned agreement. 6. The following conditions are included in the variance: a. CIG shall provide off-street parking on the site as required by the Zoning Ordinance. b. All other provisions of the Zoning Ordinance shall be adhered to in their entirety. CONCLUSION The variance for a front yard setback of 15 feet instead of the required 20 feet is hereby granted based upon the findings set forth above and subject to the conditions set forth in Paragraph 5 of the findings.
