RESOLUTION NO. 7131
A RESOLUTION AMENDING RESOLUTION NO. 6193 ADOPTED
DECEMBER 18, 1978, GRANTING PERMIT UNDER SECTION 14-124.101
OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING
TO PERMIT A 128 -UNIT CONDOMINIUM MULTI -FAMILY DEVELOPMENT
FOR PROPERTY IN THE P.U.D., PLANNED UNIT DEVELOPMENT
DISTRICT, AT 3400 LOUISIANA AVENUE SOUTH (3300-3320 LOUISIANA
AVENUE SOUTH)
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. C.M.I. Real Estate and Development, Inc. has made application to the City
Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance
Code for the purpose of permitting construction of a 128 -unit multiple -family building
located at 3400 Louisiana Avenue South (3300-3320 Louisiana Avenue South) for the
legal description as follows, to -wit:
Lot 1, Block 4, Oak Park Village
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 82 -24 -SP) and the effect of the proposed multiple -
family building on the health, safety and welfare of the occupants of the surrounding
lands, existing and anticipated traffic conditions, the effect on values of properties in
the surrounding area, the effect of the use on the Comprehensive Plan, and compliance
with the intent of the Zoning Ordinance.
3. The Council has determined that the proposed multiple -family building will
not be detrimental to the health, safety, or general welfare of the community nor will
they cause serious traffic congestion nor hazards, nor will they seriously depreciate
surrounding property values, and the proposed multiple -family building is in harmony
with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit the proposed multiple -family building at the location
described is granted based on the findings set forth above and subject to the following
conditions:
1. That the site be developed, used and maintained in accordance with
the Site Plan and Development Exhibits Al, A3, A4, A5, A6, A7, A8,
A9, A10, All, A14, A15, A16, A17, A18, A19, A20, A22, A23, and
A24, except that minor adjustments and interior wall locations,
equipment and facilities may be made to meet code requirements as
may be required to accommodate electrical mechanical, structural and
other requirements.
2. All improvements, including the building, landscaping, parking, access,
outdoor amenities, curbing and paving, and all other items as shown
on the exhibits shall be completed by June 15, 1980.
3. That the following design specifications be established for the purpose
of enclosing balconies:
All exterior framing must be anodized aluminum or solid
hardwood colored or stained an earthtone brown to match
the redwood and brick exterior of the building. The entire
enclosure shall be glazed (except for the frame) which must
be safety (tempered) glass or must provide a guardrail on
the inside when not on the ground floor. No guardrailing
shall be allowed on the outside. Where sliding doors or
sections are provided, they must slide horizontally the full
length of the enclosure, and guardrails must be provided on
the inside when not on the ground floor. All panels shall be
of uniform width and length measuring a minimum of three
feet and a maximum of four feet and seven feet high and
shall be placed within six inches of the outside edge of the
balcony or patio. Where screen panels are provided, they
must be the same length and width as the glass panels, and
exterior materials and colors shall match those specified for
the exterior framing. All such enclosures must meet the
City's building codes and architectural code.
