HomeMy WebLinkAbout7129 - ADMIN Resolution - City Council - 1982/05/03r f 1 itai.p,,,, /-14,64L, t. 74g4 ii- 7 z3 - RESOLUTION NO. 7129 A RESOLUTION AMENDING RESOLUTION NO. 5537 ADOPTED JUNE 7, 1976, GRANTING PERMIT UNDER SECTION 13-156(17) (formerly Section 6:122.17) OF THE ZONING ORDINANCE FOR MODIFICATION AND EXPANSION OF A CLASS I RESTAURANT FOR PROPERTY LOCATED IN THE B-2, GENERAL BUSINESS DISTRICT, AT 5916 EXCELSIOR BOULEVA RD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. David Bongiorno has made application to the City Council for a special permit under Section 14-156(17) of the St. Louis Park Ordinance Code for the purpose of modification and expansion of a Class I Restaurant located at 5916 Excelsior Boulevard for the legal description, as follows,. to -wit: Beginning at the point of intersection of the north line of Excelsior Avenue with the west line of the right of way of the Minneapolis, Northfield and Southern Railway, thence southwesterly along the northerly line of Excelsior Avenue 150 feet, then at right angles northwesterly 120 feet, then at right angles northeasterly 40feet, then at right angles northwesterly 18.5 feet to a point distant 170 feet at right angles from the east line of Jackson Street, then north parallel with Jackson Street 337.6 feet to the west line of the right of way of the Minneapolis, Northfield and Southern Railway, then southeasterly along said right of way 446.5 feet to the point of beginning 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 82 -21 -SP) and the effect of the proposed modification and expansion on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed modifications will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed modifications is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit expansion and modification of an existing facility at the location described is granted based on the findings set forth above and subject to the following conditions: a. • The site be developed, used and maintained in accordance with Exhibit A, Site Plan/Landscape Plan; Exhibit B, Proposed Floor Plan; and Exhibit C, Elevation Plans. b. All improvements shown on Exhibits A, B, and C, including buildings and structures, building facings and materials, landscaping, curbing, paving and parking lot striping, shall be completed by June 1, 1977. c. The entryway be walled in and a canopy be added over the front entrance in accordance with the following conditions: (1) The site shall be developed, used and maintained in accordance with Exhibit D, Exterior Elevations; Exhibit E, Waitress Station Plan; and Exhibit F, Site Plan.
