HomeMy WebLinkAbout7101 - ADMIN Resolution - City Council - 1982/04/05r 10 1 RESOLUTION NO. 7101 A RESOLUTION GRANTING PERMIT UNDER SECTION 14-141 OF THE ORDINANCE CODE RELATING TO ZONING TO PERMIT A 30 UNIT APARTMENT CONDOMINIUM FOR PROPERTY LOCATED IN THE R-4, MULTIPLE FAMILY DISTRICT, AT 4550 MINNETONKA BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Michael Halley has made application to the City Council for a special permit under Section 14-141 of the St. Louis Park Ordinance Code for the purpose of constructing a 30 unit apartment condominium located at 4550 Minnetonka Boulevard for the legal description as follows, to -wit: Lot 2, Block 1, Daystar Addition 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 82 -7 -SP) and the effect of the proposed 30 unit apartment condominium on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the 30 unit apartment condominium will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed apartment condominium is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a 30 unit apartment condominium at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit 1, Site Plan; Exhibit 2, Garage Floor Plan; Exhibit 3, Typical Floor Plan; Exhibit 4, South, West, East and North Elevations; and Exhibit 5, Landscape Plan. 2. That easements, rights, and/or a fire lane be established along the east side of the building. 3. That all concrete curbing be poured in place. 4. That the maximum ground floor area ratio not exceed .25 taking into account bonus and deduction for inside recreational space and permitting minor adjustments to the building floor plans to meet ordinance requirements. 5. That all improvements. including the buildings, parking, paving, sidewalk, berming, landscaping, and other features as contained on the exhibits be completed by May 15, 1983.
