A RESOLUTION AMENDING RESOLUTION 6173 GRANTING PERMIT UNDER
SECTION 14-124 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING
TO ZONING TO PERMIT A NINE STORY OFFICE BUILDING, DRIVE-IN
BANKING FACILITY, AND CLASS III RESTAURANT FOR PROPERTY
LOCATED IN THE DDD, DIVERSIFIED DEVELOPMENT DISTRICT, AT
1355 ZARTHAN AVENUE.
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Lake West and Frantz Klodt & Sons, Inc. have made application to
the City Council for a special permit under Section 14-124 of the St. Louis
Park Ordinance Code for the purpose of constructing a nine story office
building, drive-in banking facility, and Class III Restaurant at 1355 Zarthan
Avenue for the legal description as follows, to -wit:
Lots 3, 4, 5, 6, and 7, Block 2, and that part of Lot 2, Block 2,
lying westerly of a line 270 feet west.of, measured at a right angle
to and parallel with, the east line of its northerly extension of
said Lot 2, Block 2; and the westerly and southwesterly half of
Candlestick Drive adjoining Lots 5, 4, 3, and part of Lot 2, all
in Block 2, lying between the easterly extension of the north line
of said Lot 5, Block 2, and a line 270 feet west of, measured at
a right angle to and parallel with the east line and its northerly
extension of said Lot 2, Block 2, all in Minneapolis Baseball and
Athletic Association Addition.
2. The City Council has considered the advice and recommendation of
the Planning Commission (Case No. 78 -127 -DDD and 81 -114 -SP) and the effect
of the proposed nine story office building, drive-in banking facility, and
Class III Restaurant on the health, safety, and welfare of the occupants
of the surrounding lands, existing and anticipated traffic conditions, the
effect on values of properties in the surrounding area, the effect of the
use on the Comprehensive Plan and compliance with the intent of the Zoning
Ordinance.
3. The Council has determined that the proposed nine story office
building, drive-in banking facility, and Class III Restaurant will not be
detrimental to the health, safety or general welfare of the community nor
will it cause serious traffic congestion nor hazards, nor will it seriously
depreciate surrounding property values; and the proposed nine story office
building, drive-in banking facility, and Class III Restaurant are in harmony
with the general purpose and intent of the Zoning Ordinance and the Compre-
hensive Plan.
Conclusion
The special permit to permit a proposed nine story office building, drive in
banking facility, and Class III Restaurant at the location described is
granted based on the findings set forth above and subject to the following
conditions:
1. The site shall be developed, used and maintained in accordance
with Exhibit A, Site Plan; Exhibit B, Planting and Lighting
Plan; Exhibit C, Grading Plan; Exhibit D, Garage Level Plan;
Exhibit E, Elevation Plans; Exhibit F, Site Plan and Utility
Diagram, except as modified by the Planning Department on
November 8, 1978.
2. All landscaping, parking improvements, curbing, sodding,
building construction and related elements as shown on the
exhibits shall be completed by October 15, 1980.
3. That a Class III Restaurant be allowed on the first floor as
shown on Exhibit G, Cafeteria, containing no more than 1,800
square feet of floor area and without any exterior signage.
