LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT GRADING, FILLING, AND EXCAVATING FOR A PARKING LOT AND PONDING AREA FOR PRO- PERTY LOCATED IN THE B-2, GENERAL BUSINESS DISTRICT, AND F-2, FLOOD PLAIN DISTRICT, AT 6600 EXCELSIOR BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Excelsior Clinic has made application to the City Council for a special permit under Section 14-123.100(2) of the St. Louis Park Ordinance Code for the purpose of grading, filling, and excavating for a parking lot and ponding area located at 6600 Excelsior Boulevard for the legal description as follows, to -wit: Lot 1, Block 1, and also that part of Lot 2, Block 1, lying Easterly of a line drawn parallel with and 200 feet Easterly of, measured at right angles to, the West line of said Lot 2 and the Southerly extension thereof; all in Creek Terrace Addition, Hennepin County, Minnesota and The Southerly 210 feet of Lot 2, measured at right angles to the South line of said Lot 2 except the Westerly 100 feet of Lot 2, measured at right angles, to the West line of said Lot 2 and except thatpart of Lot 2 lying Easterly of a line and its Southerly extension drawn parallel with and 200 feet Easterly of, measured at right angles, to the West line of Lot 2, Block 1, Creek Terrace Addition according to the plat thereof on file and of record in the office of the Registrar of Titles in and for said County. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 81 -102 -SP) and the effect of the proposed grading, filling, and excavating on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of pro- perties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed grading, filling, and excavating will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed grading, filling, and excavating is in harmony with the general purpose and intent of the Zoning Ordi- nance and the Comprehensive Plan. Conclusion The special permit to permit grading, filling and excavating for a parking lot and ponding area at the location described is granted based on the findings set forth above and subject to the following conditions: 1) The site shall be developed, used and maintained in accordance with Exhibit A, Site and Grading Plan. 2) The Special Permit shall not be issued until the project has been approved by the Minnehaha Creek Watershed District. 3) A permit shall be required from the City Engineer to allow the construction of the storm sewer on City property. Said construction shall be inspected by the City and the cost of such inspection shall be borne by the applicant. 4) The applicant shall describe an easement for drainage purposes from the property line to Minnehaha Creek on City property. The applicant shall secure such easement from the City for the purpose of discharging storm water across City property. 5) That an additional sidewalk easement along Louisiana Avenue and along the westerly 110 feet adjacent to Excelsior Boulevard be dedicated to the City if so requested by the City. 6) All improvements shall be completed by May 30, 1982.
