LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT EXPANSION OF A TREATMENT CENTER FOR PROPERTY LOCATED IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT, AT 3705 PARK CENTER BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Parkview Centers, Inc. has made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code for the purpose of expanding a treatment center located at 3705 Park Center Boulevard for the legal description as follows, to -wit: That part of Lot 2, Block 2, PARK CENTER, according to the recorded plat thereof, described as follows: Commencing at the intersection of the east line of said Lot 2 and a line 24.00 feet northerly of, measured at a right angle to and parallel with the south line of said Lot 2; thence westerly, along said parallel line, a distance of 423.00 feet; thence northerly, parallel with said east line, a distance of 401.00 feet to the beginning of a line hereinafter described as "Line A"; thence northwesterly deflecting to the left 16 degrees 35 minutes 14 seconds, to the southerly right-of-way line of Park Center Boulevard as dedicated in said plat of PARK CENTER and said "Line A" there terminating; thence easterly, along said southerly right-of-way line, to the intersection with a line 60.00 feet easterly of, measured at a right angle to and parallel with said "Line A" and the point of beginning of the land to be described; thence southeasterly, along the last described parallel line, to the intersection with a line drawn westerly, parallel with the south line of said Lot 2, from a point on the east line of said Lot 2 distant 401.00 feet northerly from the point of commencement; thence easterly along the last described parallel line, to east line of said Lot 2; thence northerly, along said east line, to the northeast corner of said Lot 2; thence westerly, along the north line of said Lot 2, to the easterly right-of-way line of Park Center Boulevard; thence southerly and southwesterly, along the easterly and southeasterly right-of-way line of said Park Center Boulevard to the point of beginning. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 81 -91 -SP) and the effect of the proposed expansion of a treatment center on the'health, safety and welfare of the occu- pants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed expansion will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed expansion is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensiv Plan. Conclusion The special permit to permit expansion of a treatment center at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit A, Landscape and Grading Plan; Exhibit B, Elevation Plan; Exhibit C, Sheet 1 and 2, Floor Plans, New Addition; Exhibit J, Original Elevation Plan; and Exhibit K, Floor Plan, Original Construction. 2. That all utilities be placed underground and there be no outdoor storage of trash or materials. 3. That the site be used as a medical treatment center for 63 beds (35 beds in the old addition and 28 beds in the new addition), ancillary facilities, and corporate offices. 4. That a five foot wide sidewalk be constructed approximately five feet off from the curb line tying to the existing sidewalk adjacent to Byerly's and extending to the easterly limits of the property. 5. That the curbing in the parking lot be poured in-place concrete curbing measuring at least six inches above grade. 6. That a Contract for Private Development be executed with the Housing and Redevelopment Authority. 7. That all improvements including buildings, landscaping, parking, utilities, sidewalk, curbing, and all other elements contained on the exhibits be completed by May 15, 1983.
