LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT A FIVE STORY ATRIUM OFFICE BUILDING FOR PROPERTY LOCATED IN THE DDD, DIVERSIFIED DEVELOPMENT DISTRICT, AT 1660 SOUTH HIGHWAY 100 (PREVIOUSLY ADDRESSED 5305 GAMBLE DRIVE) BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. MEPC American Properties has made application to the City Council for site plan approval under Section 14-124 of the St. Louis Park Ordinance Code for the purpose of constructing a five story atrium office building located at 1660 South Highway 100 (previously addressed 5305 Gamble Drive) for the legal description as follows, to -wit: All that part of the south one half of the southwest quarter of Section 30, Township 29 North, Range 24 West, Hennepin County, Minnesota lying westerly of the westerly right-of-way line of State Trunk Highway 100; lying northerly of the northerly right-of-way line of Cedar Lake Road; lying southerly of a line drawn parallel with and 66' southerly, measured at right angles from the following described land: beginning at a point in the west line of said Section 30, which point is 200 feet south of the north line of the said south one half of the southwest quarter of Section 30, as measured at right angles to said north line, thence running south 00, 40' 40" east along said west line of Section 30, a distance of 258.6 feet to the actual point of beginning of the line to be described; thence running north 890, 19' 20" east, a distance of 680.10 feet, more or less, to a point in the southerly extension of the west line of Registered Land Survey No.,864 files of the Register of Titles, County of Hennepin, said point being 424.97 feet south of the southwest corner of said Registered Land Survey No. 864, as measured along said southerly extension, thence running south 890 28' 6" east, a distance of 781.27 feet, more or less, to a point in said westerly right-of-way line of State Trunk Highway 100 and there terminating; and lying easterly of the following described line: beginning at a point in the southerly extension of the west line of said Registered Land Survey No. 864, said point being 424.97 feet south of the southwest corner of said Registered Land Survey No. 864 as measured along said southerly extension, thence running south 890 19' 20" west, a distance of 7.12 feet to the actual point of beginning of the line to be described, thence running south 0° 35' 39" east, a distance of 704.77 feet, more or less, to a point in said northerly right-of-way line of Cedar Lake Road and there terminating. For the purpose of this description, said southerly extension of the west line of Registered Land Survey No. 864 is considered to be a line bearing north. This is the area bounded on the north by Gamble Drive, on the west by the northerly spur of the Burlington Northern Railroad, on the south by Cedar Lake Road, and on the east by State Highway 100. 2. The City Council has considered the advice and recommendation of the Planning Conmiission (Case Nos. 78 -80 -DDD & 81 -86 -SP) and the effect of the proposed five story atrium office building on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and consistency with the require- ments of the Diversified Development District. 3. The Council has determined that the five story atrium office building will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed five story atrium office building is in harmony with the general purpose and intent of the Diversified Development District and the Comprehensive Plan. Conclusion Approval of the site plan for the five story atrium office building is granted based on the findings set forth above and subject to the following conditions: 1. The site shall be developed, used and maintained in accordance with the plans prepared by Baker Associates Inc., architects, and described as Exhibit A; Exhibit B, Site Plan and Grading Plan; Exhibit C, Site Cross -Sections A -F; Exhibit D, Cross Section of Parking Garage and Walkway; Exhibit E, Cross -Section; Exhibit F, Typical Floor Plans; and Exhibit G, Building Elevation Plans. 2. All site improvements shall be completed by October 15, 1980. a 3. That a Class III Restaurant not to exceed 3,168 gross square feet and 2,092 net square feet be allowed in accordance with the following conditions: a. The cafeteria shall be developed in accordance with Exhibit H, First Floor Plan, and Exhibit I, Restaurant Floor Plan, as amended to delete the reference to wine along the serving line. b. No signage or other evidence of the cafeteria shall be allowed on the exterior of the building. c. All construction shall be completed by May 30, 1982.
