LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT CONSTRUCTION OF 27 UNIT APARTMENT CONDOMINIUM FOR PROPERTY LOCATED IN THE R-4, MULTIPLE FAMILY RESIDENCE DISTRICT, AT 4550 MINNETONKA BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Michael Halley has made application to the Ci,ty-.�Council~foa'special permit under Section_1,4-141_of the St: Louis'Park-Ordinance Code for the pur- pose of constructing a 27 unit apartment condominium for property located at 4550 Minnetonka Boulevard for the legal description as follows, to -wit:' Lots 1 to 10 inclusive and that part of Oakenwald Avenue now vacated between extensions eastward of the north line of said Lot 1 and the South line of said Lot 10, McCarty's 2nd Addition to Fern Hill, according to the plat thereof on file or of record in the office of the Register of Deeds in and for said County. Also that part of the South 1/2 of the Southwest 1/4 of the Southwest 1/4 of Section 31, Township 29, Range 24 lying West of a line commencing at a point 50 feet west of the southwest corner of Lot 7, Block 2, McCarty's 1st Addition to Fern Hill and running in a northerly direction from said point parallel with the west line of Block 2, McCarty's 1st Addition to Fern Hill to the north line of the South 1/2 of the Southwest 1/4 of the Southeast 1/4 of said Section 31 except that part thereof,embraced in the plat of McCarty's 2nd Addition to Fern Hill 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 81 -82 -SP) and the effect of the proposed 27 unit condominium development on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic condi- tions, the effect on values,.of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the -intent of the Zoning Ordinance. 3. The Council has determined that the proposed 27 unit condominium development will not be detrimental to the heatlh, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed 27 unit condominium development is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. . Conclusion The special permit to permit a 27 unit condominium development at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit 1, Site Plan; Exhibit 2, Garage Floor PLan; Exhibit 3, Typical Floor Plan; Exhibit 4, South Elevation; Exhibit 5, North Elevation; Exhibit 6, East and West Ele- vation; and Exhibit 7, Landscape Plan. 2. That an easement be provided for sidewalk usage along the south' side of the property. 3. That easements, rights, and/or a fire lane be established along the east side of the building. 4. That all concrete curbing be poured in place. 5. That all improvements including the buildings, parking, paving, sidewalk, berming, landscaping, and other features as contained on the exhibits be completed by May 15, 1983.
