LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT A 64 UNIT APARTMENT BUILDING AND OFFICE SPACE FOR PROPERTY LOCATED IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT AT 3005 OTTAWA AVENUE SOUTH AND 4725 MINNETONKA BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Park Hill Investment Company has made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code for the purpose of permitting a 64 unit apartment building and 5,120 square feet of office space located at 3005 Ottawa Avenue South and 4725 Minnetonka Boulevard for the legal description as follows, to -wit: Lots 1 to 6 inclusive and Lots 9 and 10, commencing two rods south of'a point 12 rods west from NE corner of NW 1/4 of Section 6 County of 28 Range 24 advance south 20 rods thence west 8 rods thence north 20 rods thence east 8 rods to beginning including adjacent 1/2 of vacated alley, except road, Mazey & Langans Addition to St. Louis Park 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 81 -80 -SP) and the effect of the proposed apartment building and office space on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed apartment building and office space will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed apartment building -and office space is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a 64 unit apartment building and 5,120 square feet of office space is granted based on the findings set forth above and subject to the following conditions: 1. The uses be limited to multiple family not to exceed 64 units and office not to exceed a gross floor area of 5,120 square feet and a net floor area of 4,255 square feet. 2. That at least 85 parking spaces be retained on the property. 3. That the office remain separated from the apartment function in terms of not providing any direct access to the corridors and that •the separate entrance to the office area from the outside be retained. • 4. That the site be used as shown on Exhibit A, Site Plan. 5. That any signage be consistent with applicable provisions of the Zoning Ordinance.
