LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT CONSTRUCTION OF A ONE STORY OFFICE BUILDING AND CLASS Iw RESTAURANT FOR PROPERTY IN THE DDD, DIVERSIFIED DEVELOPMENT DISTRICT, AT 900/ - BE IT RESOLVED BY the City Council of -the City of St. Louis Park: Findings 1. Frantz Klodt & Son, Inc. has made application to the City Council for a special permit under Section 14-124 of the St. Louis Park Ordinance Code for the purpose of constructing a one story office building and Class Iw Restaurant located at for the legal description as follows, to -wit: Tract,A Registered Land Survey No. 1512 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 81 -45 -SP) and the effect of the proposed one story office building and Class Iw Restaurant on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed one story office building and Class Iw Restaurant will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards nor will it seriously depreciate surrounding property values, and the proposed office building and Class Iw'Restaurant are in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a one story office building and Class Iw Restaurant at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit A, Site Plan/Floor Plan; Exhibit B, Grading Plan and Site Utility Plan and Lighting and Planting Plan; and Exhibit C, Easterly, Westerly, and Southerly Elevation. 2. That the restaurant contain no more than 800 square feet of net floor area or that the total parking reduction not be greater than 25% taking into account the net floor area in office and restaurant usage unless a parking agreement is executed in a form approved by the City Attorney and filed as a deed restriction on the properties involved. 3. All outside lighting be directed perpendicular to the ground. 4. That access to the frontage road is temporary and subject to removal at the discretion of the City and/or Minnesota Depart- ment of Transportation. 5. That the restaurant be provided with an inside trash room and that all trash from the restaurant be stored within the structure. 6. That there be no outside storage of trash in dumpsters or in any other containers. 7. That no active use be made of the basement area other than storage by tenants on the main floor of the subject building or by tenants in the nine story building at 5775 Wayzata Boulevard. 8. That the building, parking, landscaping and other facilities as shown on the exhibits be completed by October 15, 1982.
