LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT CONSTRUCTION OF 48 UNITS OF TOWNHOUSES FOR PROPERTY IN THE R-3, TWO FAMILY RESIDENCE DISTRICT, AT 2540-2590 ALABAMA AVENUE BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Jyland Construction Company, Inc. has made application to the City Council for a special permit under Section 14-195(3) of the St. Louis Park Ordinance Code for the purpose of constructing 48 units of townhouses located at 2540-2590 Alabama for the legal description as follows, to -wit: The South 177.22 feet of Lot 1 and all of Lots 2 through 5, Block 2, Parkaire Addition 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 81 -34 -SP) and the effect of the proposed townhouses on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the townhouses will not be detrimental to the health, safety or general welfare of the community nor will they cause serious traffic congestion nor hazards, nor will they seriously depreciate surrounding property values, and the proposed townhouses are in harmony with the _general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit 48 townhouse units at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site shall be developed in accordance with Exhibit A, Site Plan, Revision D; Exhibit B, Woody Plant Material, dated 4/1/81; Exhibit C, Lighting, Fencing and Ground Plan dated 4/2/81; Exhibit D, Preliminary Grading and Drainage Plan, Revision C, with staff note added to retain fire access over the railroad grade at its present location; Exhibit E, Elevations dated 1/28/81; and Exhibit F, Utility Plan, Revision C, as modified by the City Engineer. 2. All structures must have a lowest floor elevation of at least 173.7 feet, City datum. 3. The existing access over the railroad grade must be kept accessible to emergency vehicles until such time as an alter- native access is available to the property to the west. Such access may be across the subject property on the reserve strip or elsewhere. 4. The applicant and successors agree that the area designated as a reserve strip is to be provided at no cost to the City including its future use as a roadway. 5. All lighting shall be placed so as to direct the light rays perpendicular to the ground. 6. All improvements on the site shall be completed by October 31, 1982.
