LOUIS PARK ORDINANCE CODE TO PERMIT A MOTOR FUEL STATION AT 6011 EXCELSIOR BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Holiday Station Stores, Inc. (Erickson Petroleum Corporation) has made application to the City Council for a special permit under Section 14-150 (6:111.3(31)) of the St. Louis Park Ordinance Code to permit a motor fuel station reactivation and expanded retail store at 6011 ,E)ccelsior Boulevard for the legal description as follows, to -wit: Lot 2, Brookside Subsidivision, No. 2, except for the following: Commencing on the northeast corner of said lot; thence southerly along the easterly line of said lot 72 feet; thence westerly parallel to the southerly line of said lot 16.5 feet; thence parallel to the east line of said lot to the northerly line thereof; thence easterly along the northerly line of said lot to beginning; Lots 3 and 4, Brookside Subdivision No. 2. 2. The,City Council has considered the advice and recommendation of the Planning Commission (Case -No. 81 -6 -SP) and the effect of the proposed motor fuel station on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan. 3. The Council has determined that the motor fuel station will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed motor fuel station is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a motor fuel station at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site be developed, used, and maintained in accordance with Exhibit A, Site Plan; Exhibit B, Elevation Plan; and Exhibit C, Sign Plan, as modified by the Planning Department on 5/11/73. 2. That the free standing sign be located not less than 20 feet from the easterly right of way line of Alabama Avenue and not less than 15 feet from the southerly right of way line of Excelsior Boulevard. 3. That all improvements, including buildings, paving, curbing, striping, landscaping, lighting, and signing be completed by October 1, 1974. 4. That Conditions 1-3 are hereby deleted. 5. That the existing special permit is hereby modified by the following conditions: a. That the site be developed in accordance with Exhibit -D, Site Plan (as modified by the Planning Department on 1/15/1981); Exhibit E, Sign Details; and Exhibits F and G, Canopy Letter Locations b. That all improvements be completed including canopy, curbing,striping, landscaping, and signage no later than November 15, 1981.
