A RESOLUTION GRANTING PERMIT UNDER SECTION 14-126(5) OF
THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO
PERMIT A 34 UNIT CLUSTER HOUSING FOR PROPERTY LOCATED IN
THE R-1 DISTRICT ON WESTWOOD HILLS ROAD
BE IT RESOLVED BY the City Council of the City of Si. Louis Park:
Findings
1. Skyehill Company has made application to the City Council for
a special permit under Section 14-126(5) of the St. Louis Park Ordinance
Code for the purpose of constructing cluster housing located on Westwood
Hills Road for the legal description as follows, to -wit:
That part of the Northwest Quarter of the Southwest Quarter, Section 5,
Township 117, Range 21 described as beginning at a point on the West line
of said Northwest Quarter of the Southwest Quarter distant 330 feet South
from the Northwest corner of said Northwest Quarter of,the Southwest Quarter;
thence East parallel with the North line of said Northwest Quarter of the
Southwest Quarter a distance of 354.1 feet; thence South to a point on the
South line of the North Half of said Northwest Quarter of the Southwest
Quarter distant 349.92 feet East from the Southwest corner of the North
half of said Northwest Quarter of the Southwest Quarter; thence hest along
said South line to a point 170 feet East from the Southwest corner of the
North Half of said Northwest Quarter of the Southwest Quarter; thence North
parallel with the Hest line of said Northwest Quarter of the Southwest Quar-
ter a distance of 150 feet; thence West parallel with said South line a
distance of 170 feet to the West line of said Northwest Quarter of the
Southwest Quarter; thence North along said West line to the point of
beginning, according to the Government Survey thereof. A part of the
North line is narked by Judicial Landmarks set pursuant to Torrens Case
No. 16472 and the East and South lines are marked by Judicial Landmarks
set pursuant to Torrens Case No. 16964.
That part of the Northeast Quarter of the Southeast Quarter of Section 6,
Township 117, Range 21 lying Northeasterly of a line drawn from a point
on the North line of said Northeast Quarter of the Southeast Quarter
distant 863.7 feet East of the Northwest corner thereof to a point on
the East line of said Northeast Quarter of the Southeast Quarter distant
230 feet South of the Northeast corner thereof.
That part of the Northwest Quarter of the Southwest Quarter, Section 5, Town-
ship 117, Range 21 described as beginning at the Northwest corner of said North-
west Quarter of the Southwest Quarter; thence East along the north line of
Southwest Quarter of said Section 5 a distance of 198 feet; thence South
parallel with the West line of said Southwest Quarter a distance of 330
feet; thence West parallel with the North line of said Southwest Quarter
a distance of 193 feet to the West line of said Southwest Quarter; thence
North along said West line 330 feet to the point of beginning. The boundary
lines of the premises are marked by Judicial Landmarks set pursuant to Torren
Case No. 16472.
That part of the East 160 feet, as measured at right angles to the East
line of the North Quarter of the Northeast Quarter of the Southeast Quarter
of Section 6, Township 117, Range 21 lying Southerly of a line drawn from
a point on the North line of said Northeast Quarter of the Southeast Quarter
distant 863.7 feet East of the Northwest corner thereof to a point on the
East line of said Northeast Quarter of the Southeast Quarter distant 230
feet South of the Northeast corner thereof. The boundary lines of the
prer►ises are marked by Judicial Landmarks set pursuant to Torrens Case No.
16472.
That part of the East 160 feet of the South Ralf of the North Half of the
Northeast Quarter of the Southeast Quarter of Section 6, Township 117,
Range 21 which lies North of a line 150 feet North of the South line of
said North Half of the Northeast Quarter of the Southeast Quarter.
Also that part of the Northwest Quarter of the Southwest Quarter, Section 5,
Township 117, Range 21 described as beginning at the Southwest corner of the
North Half of said Northwest Quarter of the Southwest Quarter; thence East
along the South line of the North Half of said Northwest Quarter of the
Southwest Quarter a distance of 170 feet; thence North parallel with the
West line of said Northwest Quarter of the Southwest Quarter a distance
of 150 feet; thence West parallel with said South line a distance of 170
feet to the West line of said Northwest Quarter of the Southwest Quarter;
thence South along said West line a distance -of 150 feet to the point of
beginning, according to the Government Survey thereof. `
And also that part of the Northwest Quarter of the Southwest Quarter of
Section 5, Township 117, Range 21, described as follows: Beginning at a
point in the West line of said Northwest Quarter of the Southwest Quarter,
therein distant 825.00 feet Southerly of the Northwest corner of said
Northwest Quarter of theSouthwest Quarter; thence Easterly at a right
angle 190.00 feet; thence Northerly at a right angle to the South line
of the North Half of the Northwest Quarter of the Southwest Quarter of
said Section 5; thence Westerly along said South line to the West line
of said Northwest Quarter of the Southwest Quarter; thence Southerly along
said West line to the point of beginning. Also to be known as Skyehill
Townhomes at such time and thereafter that said plat is filed with Hennepin
County.
2. the City Cour►ci1 has considered the advice and r<cowendation of
the Planning Commission (Case No. 80 -92 -SP) and the effect of the proposed
cluster housing on the health, safety and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect
on values of properties in the surrounding area, and the effect of the use
on the Comprehensive Plan.

3. The Council has determined that the cluster housing will not be
detrimental to the health, safety or general welfare of the community nor
will it cause serious traffic congestion nor hazards, nor will it seriously
depreciate surrounding property values, and the proposed cluster housing is
in harmony with the general purpose and intent of the tonir►g Ordinance and
the Comprehensive Plan.

Conclusion
The special permit to permit 34 units of cluster housing at the location
described is granted based on the findings set forth above and subject to
the following conditions:
1. That the site be developed, used and maintained in
accordance with Exhibit A, Site Development Plan;
Exhibit B, Landscape Plan; Exhibit C, Final Plat
of Skyehill Townhomes; Exhibit D, Elevation Plans
which are to serve as general illustrations of the
form and character of the individual units without
restricting inclusion of additional design features
to serve the individual needs of the purchasers,
developer, or enhancement of the development poten-
tial of the site.

2. That all utilities be placed underground.
3. That the pedestrian way be extended to the east
to terminate at the westerly curb line of Texas
Avenue.
4. That proper construction techniques be employed
to prevent erosion and to minimize and prevent
adverse environmental impacts during construction.
5. That all trees, to be retained as shown on the
Landscape Plan, be marked and physically protected
during construction to prevent harm or destruction.
6. That all construction he completed by October 15, 1932,
except for the Foss property which may he completed at
a later date if agreement on the sale and development
of the property has not been reached in sufficient time
prior to that date to allow completion of the plan.
