A RESOLUTION AMENDING RESOLUTION 6376 GRANTING
PERMIT UNDER SECTION 14-124 OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO PERMIT THE
EXPANSION OF A CLASS I RESTAURANT IN THE DIVERSIFIED
DEVELOPMENT DISTRICT AT 5600 WAYZATA BOULEVARD
BE IT RESOLVED BY the City Council of St. Louis Park:
Findings
1. Garcia's Restaurants, Inc. and Western Properties, Ltd. have made
application to the City Council to amend a special permit under Section
14-124 of the St. Louis Park Ordinance Code for the purpose of expansion
of a Class I Restaurant located at 5600 Wayzata Boulevard for the legal
description as follows, to -wit:
That part of Lot 5, Section 4, Township 117 North,
Range 21 West of the 5th Principle Meridian, lying
between the old Wayzata Boulevard (also known as
Superior Blvd.) and the new Wayzata Boulevard (also
known as State of Minnesota #12)
2. The City Council has considered the advice and recommendation of
the Planning Commission (Case No. 80 -82 -SP) and the effect of the proposed'
expansion of a Class I Restaurant on the health, safety and welfare of
the occupants of the surroundina lands, existing and anticipated traffic
conditions, the effect on values of properties in the surrounding area,
the effect of the use'on the -Comprehensive -Plan, and compliance with the
intent of the Zoning Ordinance.
3. The Council has_determined.that'the proposed,expansi,on will not
be detrimental to the health, -safety or -general welfare of the community
nor will it cause serious traffic congestion nor hazards, nor will it
seriously depreciate surrounding property values, and the proposed expan-
sion is in harmony with the general purpose and intent of the Zoning Ordi-
nance and the Comprehensive Plan.
Conclusion
The special permit to permit the expansion of a Class I Restaurant at the
location described is granted based on the findings set forth above and
subject to the following conditions:
1. That condition a, b & d of Resolution 5324 shall be con-
tinued and condition #2, 3, 4 & 5 of Resolution No. 5790
shall be continued except as modified by the following:
a. The site shall be developed, used and maintained in accord-
ance with Exhibit M, Site Plan; Exhibit N, Sign Plan; Exhi-
bit 0, Landscape Plan; Exhibit P, Elevation Plan; and Exhi-
bit Q, Floor Plan. Landscaping and curbing on the north side
of the building shall be completed by June 15, 1981,or prior
to occupancy, whichever occurs first.
b. All trash to be stored and kept in the inside trash room,
and no outside storage of trash or other materials shall be
permitted.
c. All improvements shall be completed by October 31, 1981,
unless such earlier date is specified above.
