LOUIS PARK"ORDINANCE CODE -RELATING TO ZONING -TO PERMIT A CLASS1 RESTAURANT FOR PROPERTY LOCATED IN T -HE B-2:DISTRICT AT 6501 WAYZATA BOULEVARD BE IT RESOLVED BY the City Council of St:_Louis Park: Findings 1. Northstar Pizza Corporation has made-application-to-the-City_Council for a special permit under Section 14-156 of the St. Louis-Park,Ordinance Code -for -the purpose of -operating a Class' I Restaurant located =at -6501 =Wayzata -Boulevard for the legal - description as -follows, -to -wit: Lot 4,lBlock 1, Lou Park Addition 2. The City Council has considered the advice'and recommendation of the Planning Commission (Case No. 80 -81 -SP) and the effect of -_the -proposed _Class I Restaurant on -the -health, safety -and wel fare -of _the _occupants -of _the surrounding -lands, existing and anticipated traffic conditions,.-the=effect on values -of .properties in the surrounding area, -the -effect 'of the',use -on -the Comprehensive Plan, and compliance with the intent of`theFZoning Ordinance. 3. The Council has determined that the Class I Restaurant will not be detrimental to the health, safety or general-welfare-of=the_communi_ty nor will it cause -serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed Class I Restaurant is An -harmony with the general purpose and intent of ,the Zoning Ordinance and the Comprehensive Plan. Conclusion The. special permit to permit a Class I Restaurant at the location described is:granted based on the findingsset forth above and subject to the -following conditions: -l. That the site shall be operated and maintained in accordance with Exhibit A, Site Plan, and -Exhi- bit B, Floor'Plan/Elevations. 2. That all lighting be directed perpendicular to the ground and away from surrounding.properties and right of way. 3. That all trash storage be indoors. 4. That all landscaping be completed by July 15, 1981. Adopted by the City Council November 3, 1980 ATTEST: Reviewed for administration: Approved as to form and legality: _r 4696 CITY DEVELOPMENT City of St. Louis Park October 9, 1980 CASE NO. 80 -81 -SP SUBJECT Request of Northstar Pizza Corporation (dba Shakey's Pizza) for a special permit under Section 14-156 of the Zoning Ordinance to permit a Class I Restaurant on property in the B-2, General Business District, located at 6501 Wayzata Boulevard. PROPOSAL The applicant proposes to convert a Class 11 restaurant into a Class I restau- rant. The applicant has indicated that if the special permit to operate a Class I restaurant is approved, a license for the sale of wine only will be sought. No changes to either the interior or exterior of the building, the parking lot, or landscaping are proposed. SITE DATA Zoning - B-2 Lot Area - 55,390 sq. ft. Gross Floor Area - 5,880.4 sq. ft. Net Floor Area - 5,326 sq. ft. Dining Area - 1,725 sq.ft. Setbacks - Front - 116 ft. E. Side - 7 ft. W. Side - 33 ft. Rear - 241 ft. Parking required - 69 Parking provided - 85 EXISTING CONDITIONS The subject property is located on the south side of Wayzata Boulevard (Hwy. No. 12) between Hampshire and Dakota Avenues. The Steak and Ale restaurant is located directly to the east; Prestige Lincoln-Mercury is directly west. A Class II restaurant was developed on the site in 1967, prior to adoption of the ordinance amendment which made restaurants special permit uses in all zoning districts. The restaurant is thus a legal non -conforming use at present. The applicant's intent to seek a wine license makes it necessary to also seek a special permit. ANALYSIS The existing Class II restaurant (except for its lack of a special permit) meets the Ordinance requirements for setback, parking, etc. in the B-2, General Business District. • • City Development Case No. 80 -81 -SP Page 2 The existing and proposed restaurant uses are consistent with the Compre- hensive Plan as it relates to this area. The existing restaurant and site are generally consistent with Site Develop- ment Standards. However, to make them totally consistent, planted parking islands should be provided at the south ends of the front and rear double parking rows. Additional trees should be planted on the west side of the property. Inasmuch as the parking provided exceeds that required, provision of the necessary parking islands should pose no undue hardship on the property. RECOMMENDATIONS* It is recommended that the requested special permit for a Class I restaurant with 1725 sq. ft. of dining area be granted subject to the following conditions: 1) That the site shall be operated and maintained in accordance with Exhibit A, Site Plan; and Exhibit B, Floor Plan/Elevations. 2) That one additional ornamental tree (21/2" diameter) be planted on the two remaining front landscape islands, on the parking island to be provided on the south side of the property and every 80 feet on the west side of the property. 3) That all lighting be directed perpendicular to the ground and away from surrounding properties and right-of-way. 4) That all trash storage be indoors. 5) That all landscaping be completed by July 15, 1981. * This recommendation is based on the site plan elements being satisfactory and not on a standard or judgment with respect to whether or not a Class II Restaurant serving pizza should be allowed to serve wine and become a Class I Restaurant since on -sale wine determinations are governed by the license policies/practices of the City Council. • A P PLL6,A1 UNDER TTH e CITX *4.51.T. Case No. 80 -81 -SP -- Request of Northstar Pizza Corporation (dba Shakey's Pizza) for a special permit under Section 14-156 of the Zoning Ordinance to permit a Class I Restaurant on property in the B-2,General Business District, located at 6501 Wayzata Boulevard. The Planning Director presented the staff report and noted that the request was being made to allow the sale of wine on the premises. No other changes are proposed. The applicant, Mr. Rick Lupu, asked if Condition 2 referred to the existing islands in the parking lot. The Planning Director replied that it did. Mr. Palmer expressed surprise that Shakey's wanted to sell wine based on their family orientation. Mr. Lupu replied that it was not inconsistent as they felt it would be an added service to their customers. Ms. Ingersoll asked the applicant if the conditions as written were acceptable. Mr. Lupu stated that they were. Mr. Zimmerman asked if it was appropriate to limit the special permit to wine only. The Planning Director stated that the distinction between a Class I Restaurant limited to wine only vs. a Class I Restaurant without that limitation may become a bit nebulous and that it is probably more of a Council consideration than that of the Planning Commission. Ms. Andersen moved that the Commission recommend approval of the special permit subject to the following conditions: 1. That the site shall be operated and maintained in accordance with Exhibit A, Site Plan; and Exhibit B, Floor Plan/Elevations. 2. Mr. Palmer seconded the motion, and the motion passed on a 6-0-1 vote with Bass, Andersen, Hovland, Ingersoll, Palmer, and Zimmerman voting in favor and Elstrom abstaining.
