RESOLUTION GIVING APPROVAL OF FINAL PLAT OF FARRS
SUNSET RIDGE AND DISTRIBUTION OF THE ASSESSMENT,
PROJECT NOS. 59-55, 66-02, 7711A, 7711B, 78-22,
78-46, and 78-44 AND REPEALING RESOLUTION NO. 6635
BE IT RESOLVED BY the City Council of St. Louis Park:
Findings
1. Darrel A. Farr Development Corporation, owner and subdividers
of the land proposed to be platted as Farrs Sunset Ridge, have submitted
an application for approval of the final plat of said subdivision in the
manner required for platting of land under the St. Louis Park Ordinance
Code, and all proceedings have been duly had thereunder.
2. The proposed final plat has been found to be in all respects consis-
tent with the City Plan and the regulations and requirements of the laws of
the State of Minnesota and the ordinances of the City of St. Louis Park.
3. The proposed plat is situated upon the following described lands in
Hennepin County, Minnesota, to -wit:
That part of Government Lot 1, Section 9, Township 117, Range 21,
described as follows: Commencing at the Southwest corner of said
Government Lot 1; thence North 88 degrees 04 minutes 40 seconds East,
assumed bearing, along the South line of said Government Lot 1 a
distance of 438.47 feet to the Northerly line of the Burlington
Northern Inc. Railway right-of-way; thence North 72 degrees 50 minutes
00 seconds East along said right-of-way line 181.32 feet; thence
North 78 degrees 30 minutes 00 seconds West a distance of 265.00
feet; thence North 40 degrees 00 minutes 00 seconds West a distance
of 405.00 feet; thence North 22 degrees 56 minutes 24 seconds East
a 414.42 feet to the point of beginning of the land to be herein
described; thence South 77 degrees 41 minutes 56 seconds East a
distance of 356.09 feet; thence North 20 degrees 01 minutes 19
seconds East a distance of 96.38 feet; thence on a tangential
curve to the right, concave to the Southeast having a radius of
111.00 feet and a central angle of 69 degrees 58 minutes 41 seconds
for a distance of 135.57 feet; thence on a tangential curve to the
right, concave to the Southwest having a radius of 25 feet and a
central angle of 90 degrees 00 minutes 00 seconds for a distance
of 39.27 feet; thence South a distance of 10.00 feet; thence East
a distance of 40.00 feet to a line distant 743.7 feet West of,
measured at right angles to and parallel with the West line of
the Northwest 1/4 of Section 31, Township 29, Range 24 and its
Northerly extension; thence North along said parallel line 360.00
feet to the centerline of Old Cedar Lake Road; thence North 45
degrees 35 minutes 40 seconds West along said centerline.a distance
of 186.51 feet to its intersection with the North line of said
Government Lot 1; thence South 87 degrees 20 minutes 14 seconds
West along said North line 68.29 feet; thence South 45 degrees
35 minutes 40 seconds East parallel with said centerline 41.28
feet; thence South 60 degrees 52 minutes 36 seconds West a
distance of 80.36 feet; thence South 4 degrees 57 minutes 11
seconds East a distance of 49.13 feet; thence South 14 degrees
00 minutes 00 seconds West a distance of 225.00 feet; thence
South 50 degrees 00 minutes 00 seconds West a distance of 125.00
feet thence South 63 degrees 30 minutes p0 seconds West a distance
of 155.00 feet thence South 22 degrees 56 minutes 24 seconds West
a distance of 60.00 feet to the place of beginning.
4. The owner has offered as a gift to the City the property legally
described on Exhibit A attached hereto and made a part hereof ("Parcel A"),
and it is in the best interests of the City to accept this gift upon a
redistribption of the special assessments allocated to that parcel. Owner
has agreed to this redistribution. City staff has determined that the value
of said Parcel A is $174,000.
Conclusion
1. The proposed final plat of Farrs Sunset Ridge is hereby approved
and accepted by the City as being in accord and conformity with all_ordi-
nances, City plans and regulations of the City of St. Louis Park and the
laws of the State of Minnesota, subject to the following conditions:
a. A variance to permit 40 feet right of way.
b. Acceptance of the subdivision contract and bond
or other surety as provided by Section 14-309(2)
of the St. Louis Park Ordinance Code by the City
Attorney and the City Finance Director.
2. The City of St. Louis Park hereby accepts Parcel A as a gift from
its owner, and the City hereby redistributes existing and pending special
assessments,according to the schedule which follows from Parcel A to the
property legally described on Exhibit B attached hereto and made a part
hereof ("Parcels B and C") provid&d, however, the owner agrees to pay the

original and redistributed special assessments allocated to Parcels B and
C before any interest in those parcels is conveyed:

3. The owner agrees to enter into a stipulation to be filed in the
case of Grace A. Freidheim v. City of St. Louis Park, Hennepin County
District Court, file number 761 037, to be signed by all parties and
the present owner, releasing Parcels A, B and C from the subject of that
action and dismissing the appeal with respect to those parcels and waives
any and all rights to appeal the special assessments which are the subject
of the appeal.
4. The City Clerk is hereby directed to file a certified copy of
this Resolution in the Office of the Register of Deeds and/or Registrar
of Titles for their use as required by M.S.A. 471.29. And the City Clerk
is authorized and directed to file the deed for park land (Parcel A) in
the Office of the Hennepin County Registrar of Titles.
5. The City Clerk is hereby directed to supply a certified copy of
this Resolution to the above-named owner and subdivider, who is the appli-
cant herein.
6. The Mayor and City Manager are hereby authorized tq execute all
contracts required herein, and the City Clerk is hereby directed to execute
the certificate of approval on behalf of the City Council upon the said plat
when all the conditions set forth in Paragraph No. 1 above and Section
14-303(3)(e) of the St. Louis Park Ordinance Code have been fulfilled.

7. Such execution of the certificate upon said plat by the City Clerk,
as required under Section 14-303(3)(e), shall be conclusive showing of proper
compliance therewith by the subdivider and City officials charged with duties
above-described and shall entitle such plat to be placed on record forthwith
without further formality.
8. Resolution No. 6635 is hereby repealed.
