A RESOLUTION AMENDING RESOLUTION NO. 6475 ADOPTED ON
JANUARY 7, 1980 GRANTING PERMIT UNDER SECTION 14-113(7)
OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING
TO PERMIT GRADING AND FILLING FOR A PARKING LOT FOR PRO-
PERTY LOCATED IN THE R-1 DISTRICT AT 1615 TEXAS AVENUE
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. The Park Assembly of God Church has made application to the City
Council for a special permit under Section 14-113(7) of the St. Louis
Park Ordinance Code for the purpose of grading and filling for a parking
lot located at 1615 Texas Avenue for the legal description as follows,
to -wit:
Lot 5 , except the south 299 feet thereof, all of Lot 6, except the north
150 feet of that part of Lot 6 lying west of the east 260.5 feet thereof,
and east of the easterly line of Texas Avenue as traveled, and except that
part of Lot 6 which lies west of the west line of Texas Avenue, and except
that part embraced in the plat of TEXAS TERRACE SECOND ADDITION, BEEBE'S
OUTLOTS, according to the plat thereof on file or of record in the office
of the Register of Deeds now known as County Recorder in and for said
Hennepin County. ALSO
The west 240 feet of the north 25 feet of the south 299 feet of Lot 5,
BEEBE'S OUTLOTS, according to the plat thereof on file or on record in
the office of the Register of Deeds now known as County Recorder in and
for said Hennepin County. ALSO
Outlot-2, LAMPLIGHTER, according to the plat thereof on file and of record
in the office of the Registrar of Titles in and for said Hennepin County.
ALSO
Outlot 2, TEXAS TERRACE, according to the plat thereof on file and of
record in the office of the Registrar of Titles in and for said Hennepin
County. ALSO
Lot 8, BEEBE'S OUTLOTS, according to the plat thereof on file or of record
in the office of the Register of Deeds now known as County Recorder in and
for said Hennepin County. ALSO
Beginning on the east line of the Northwest Quarter of the Southwest
Quarter in Section 5, Township 117, Range 21, 850 feet south of the
northeast corner thereof, thence west along the south line of 14th Street
as shown in the plat of TURF AND PADDOCK, 209.8 feet to the northeast
corner of Lot 21, TURF AND PADDOCK, Hennepin County, Minnesota, thence
south along the east line of said Lot 21, to the southeast corner thereof
distant 210 feet, thence east parallel with the north line of said
Northwest Quarter of the Southwest Quarter to the east line thereof,
thence north along the east line thereof to the south line of 1'4th Street,
being the point of beginning. ALSO
That part of the Northwest Quarter of the Southwest Quarter in Section 5,
Township 117, Range 21, lying south of the south line of the plat of TURF
AND PADDOCK and east of the plat of TEXAS TERRACE THIRD ADDITION.
2. The City Council has considered the advice and recommendation of
the Planning Commission (Case No. 79 -91 -SP) and the effect of the proposed
grading and filling on the health, safety and welfare of the occupants of
the surrounding lands, existing and anticipated traffic conditions, the
effect on values of properties in the surrounding area and the effect of the
'use on the Comprehensive Plan.
3. The Council has determined that the grading and filling will not be
detrimental to the health, safety or general welfare of the community nor will
it cause` serious traffic congestion nor hazards, nor will it seriously
depreciate surrounding property values, and the proposed grading and filling
is in harmony with the general purpose and intent of the Zoning Ordinance and
the Comprehensive Plan.
Conclusion
The special permit to permit grading and filling for a parking lot at the
location described is granted based on the findings set forth above and subject
to the following conditions:
1. The parking lot, drainage facilities, landscaping and other improve-
ments shall be constructed and maintained in accordance with Exhibit A - Site
Plan, Phase I, Exhibit B - Grading and Drainage Plan, Exhibit C - Cross Sections,
-Exhibit D - Site Details and Exhibit E - Berm and Landscape Plan.
2. The trees to be planted as shown on Exhibit E shall have a minimum
diameter of two and one-half inches one foot above the ground.
3. The storm sewer in the parking lot shall remain the property of the
Park Assembly of God Church as far as the easterly property line. A drop
inlet with a clean out shall be provided on the public property and shall be
placed in City ownership.
4. Construction of the parking lot and related improvements shall be
completed by June 15, 1981.
