LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT AN OUTDOOR ADVERTISING STRUCTURE ON PROPERTY LOCATED,.IN:THE DDD, DIVERSIFIED DEVELOPMENT DISTRICT, AT 1332-ZARTHAN AVENUE 'SOUTH. BE IT RESOLVED BY the City Council of St. Louis Park: Findings 1. Naegele Outdoor Advertising 'Company of -the Twin Cities, Inc. has made application -to the City Council for a -special permit under Section 14-124 of the St. Louis Park Ordinance Code for the _purpose -of erecting an outdoor -advertising'structure'on property located at 1332 Zarthan Avenue South -for the legal description -as =follows, to wit: Lot 1, :Block 1, John Johnson's Addition 2. The City Council has considered the advice -and recommendation of the Planning Commission `(Case'No.°80-46-SP)=and the -effect of the proposed_ outdoor =advertising structure on the health., safety, and welfare of the occupants of the surrounding 1 -ands, existing -and anticipated -traffic conditions, the effect ,on values of .properties -in the surrounding -area, the -effect of the use on -the ,_Comprehensive Plan, and compliance with the -intent::of-the Zoning Ordinance. 3. -The Council has _determined that the proposed outdoor advertising structure will not be detrimental to thehealth, :safety, or general welfare of the community nor -will it cause serious traffic congestion not hazards, nor will it seriously.depreciate-surrounding property value's, and the proposed 'outdoor -advertising structure is An harmony with the general _purpose and intent of the Zoning Ordinance =and the Comprehensive Plan. 4. Naegele Outdoor'Advertising Company of the Twin Cities,.Inc. and any of its subsidiaries., .successors, or assigns -agree, through execution of an Assent Agreement, not to request, seek,', 'or construct through any device or action any-addi'tional_bilIboard or billboards (except the one authorized in this resolution) within that -portion of -the -Diversified Development District bounded ' by Highway -100 _and ,the Burlington Northern Railroad, Zarthan;Avenue -and Highway"12. 'Naegele Outdoor Advertising Company -of the -Twin .Cities, Inc. 'hereby =agrees to this -finding and the 'conditions which follow through the execution of an -Assent Agreement or other agreements containing said Iprovisions. Conclusions The special permit to permit an outdoor advertising structure at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That a single pole billboard be allowed containing no more than two faces,anI containing no more that 672 square feet per face plus an allowance for an extension of an additional 78 square feet per face for a total square foot area, counting both faces and extensions, of 1,500 square feet. 2. The height from the ground shall not be greater than 35 feet. 3. Said billboard shall not contain any moving parts. 4. No portion of the billboard shall extend northerly of the north wall of the existing principal structure on the site. 5. Prior to the issuance of the sign permit, the applicant shall be required to submit a survey showing the location,of the billboard on the site and all construction details"to determine conformance with the special permit. In addition, the Assent Agreement and/or other agreements required to fulfill the terms of this resolution shall also have been executed prior to issuance of the sign permit. 6. That all construction shall be completed by May 31, 1981. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO -PERMIT A DRIVE-IN FACILITY LOCATED IN THE F -2, -FLOOD PLAIN, AND B-2, GENERAL BUSINESS DISTRICTS, AT 3650 AND 3670 AQUILA AVENUE BE IT RESOLVED BY the City Council of St. Louis Park: Findings 1. General Growth and Development Corp. has made application to the City Council for a special permit under Section 14 -156 -and 14-123.100(2) of the St. Louis Park Ordinance Code for the purpose of building a drive-in and commercial facility on property located -at 3650 and 3670 Aquila Avenue in the F-2 District for the legal description as -follows, to -wit: Lots 1 and 2, -Block 1, Knollwood Mall First Addition 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 80 -39 -SP) and the effect'of-the proposed land reclamation by filling on the health,_safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, -and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed reclamation of land by filling will not be detrimental to the health, -safety or general -welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it -seriously depreciate surrounding'property values, and.i;he pro- posed reclamation of land by filling is in -harmony with the general-purpose and intent of the Zoning Ordinance and the Comprehensive -Plan. Conclusion The special' permit to permit drive-in and commercial facilities -at the location described is granted based on the -findings set forth-above=and subject to the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit A, Site Plan (revised 6/25/80): -Exhibit B, Building Eleva- tions: Exhibit C, West & East Elevations and Exhibit D, Landscape Plan. 2. There shall be no outdoor storage of trash or other materials. 3. All lighting shall be directed perpendicular to the ground, and away from the surrounding properties and rights-of-way. 4. There should be adequate provision for landscape watering. 5. All construction shall meet the architectural control standard for the Target-Knollwood area. 6. That all construction and improvements to the site be completed by October 15, 1981.
