A RESOLUTION AMENDING RESOLUTION NO. 6362 GRANTING PERMIT
UNDER SECTION 14-124.101 OF THE ST. LOUIS PARK ORDINANCE
CODE RELATING TO ZONING TO PERMIT THE CONSTRUCTION OF AN
OFFICE, WAREHOUSE, AND RETAIL FACILITY FOR PROPERTY LOCATED
IN A PUD, PLANNED UNIT DEVELOPMENT DISTRICT, AT 5825
EXCELSIOR BOULEVARD.
BE IT RESOLVED BY the City Council of St. Louis Park:
Findings
1. Fred G. Anderson has made application to the City
Council for a special permit under Section 14-124.101 of the
St. Louis Park Ordinance Code for the purpose of constructing
an office, warehouse, and retail facility located at 5825
Excelsior Boulevard for the legal description as follows,
to -wit:
Lots 18-29, Block 4, Suburban Homes Companies
Addition, including one-half of vacated street
(Zarthan Avenue) adjoining said lots, and the W z
of vacated Zarthan Avenue from Excelsior Blvd, S to 41st Street
2. The City Council has considered the advice and recom-
mendation of the Planning Commission (Case No. 79 -49 -SP) and
the effect of the proposed construction on the health, safety,
and welfare of the occupants of the surrounding lands, existing
and anticipated traffic conditions, the effect on values of proper-
ties in the surrounding area, the effect of the use on the Com-
prehensive Plan, and compliance with the intent of the Zoning
Ordinance.
3. The Council has determined that the proposed construc-
tion will not be detrimental to the health, safety or general
welfare of the community nor will it cause serious traffic
congestion nor hazards, nor will it seriously depreciate
surrounding property values, and the proposed construction
is in harmony with the general purpose and intent of the Zoning
Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit construction at the location
described is granted based on the findings set forth above and
subject to the following conditions:

1. The site be developed, used and maintained in accordance with
Exhibit A, special permit plans, sheet 1; Exhibit A, grading
and utilities, sheet la; Exhibit C, site landscaping, sheet 11-1;
Exhibit D, landscaping plan at entry, sheet 11-2; Exhibit E,
lower level floor plan, sheet 2a; Exhibit F, lower level floor
plan, sheet 2b and Exhibit G, upper level floor plan, sheet 3;
Exhibit H, elevations, sheet 4; Exhibit I, elevations, sheet 5,
as modified by the conditions.
2. There shall be no loading or storage of trucks on the site
except in the loading berth as shown on the approved plan.
3. There shall be no outside storage of any materials, equipment
trucks or similar items.
4. The use of the site shall be limited to office and retail
sales and showroom facilities and accessory warehousing space
used in connection with retail sales and office functions on
the site. No warehousing shall occur on the site which is
not related to the use of the office and retail area and
including the 27,000 square feet of floor areasas shown on
the plans.
5. The applicant shall provide necessary right of way and/or
easements through proper dedication to provide for at least a
5 foot pedestrian way along the front lot line adjacent to
Excelsior Boulevard.
6. Access to proposed public parking shall be provided at the west
end of the property adjacent to Excelsior Boulevard to insure
use and proper circulation for parking proposed on the railroad
property.
7. All lighting shall be directed perpendicular to the ground with
100% cut-off and no other lighting except as the lighting shown
on the plan shall be allowed on the site.
8. All trash shall be kept in enclosed containers within the building
as shown on Exhibit F, sheet 2b. Said trash area shall be closed
with doors or gates on the west side using decorative screening
material. The name plate sign shall be located in the planted
island or other landscaped areas at least 20 feet from the lot
line measured from the lot line to the nearest extension of the
sign.

9. Parking and access shall be permitted on the property previously
owned by the MN&S Railroad adjacent to the west side of the subject
property, and shall be designed and maintained according to Exhibit J.
10. All construction, improvements and landscaping shall be completed
by October 15, 1980.
