HomeMy WebLinkAbout6561 - ADMIN Resolution - City Council - 1980/05/19RESOLUTION NO. 6561 RESOLUTION REPEALING RESOLUTION NO.'6321 AND GIVING APPROVAL'FOR FINAL PLAT OF-LOHMAN'S AMHURST BE IT RESOLVED BY the City Council of St. Louis Park: Findings 1. The Cheyenne Land Company, owners -and subdividers of the land proposed to be platted as Lohman's Amhurst have submitted an application for approval of final plat of said subdivision in the manner required for platting of land under the St. Louis Park Ordinance Code, and all proceed- ings have been duly had thereunder. 2. The subdivider wishes to develop the area approved on the prelim- inary plat in stages and Section 14-303(3) provides for a final plat which comprises a portion of the area covered by the preliminary plat. 3. The proposed final plat has been found to be in all respects con- sistent with the City Plan and the regulations and requirements of -the laws of the State of Minnesota and the ordinances of the City of St. Louis Park. 4. The proposed plat is situated upon the following described lands in Hennepin County, Minnesota, to -wit: That part of the following described tracts which are in Section 18, Township 117, Range 21. That part of Tract A lying North of the South line of Section 18, Township 117, Range 21, except that part of the Southerly 411.27 feet of Tract A, as measured at right angles to the Southerly line thereof, lying Westerly of the following described line: Beginning at a point in the West line of said Tract A, 139.3 feet North of the Southwest corner of Section 18, Township 177, Range 21, thence deflecting 83 degrees 37 minutes 20 seconds to the right and running Easterly 870 feet to the actual point of beginning of the line to be described, thence deflecting 124 degrees 30 minutes to the right and running Southwesterly 315 feet to the beginning of a curve to the right having a radius of 410 feet, thence running Southwesterly along said curve to the Southerly line of said Tract A and there terminating, Registered Land Survey No. 885, Files of Registrar of Titles, County of Hennepin; which lies Westerly and Northwesterly of the following described Line A: Line A: Beginning at the Southwest corner of said Section 18; thence North 88 degrees 40 minutes East a distance of 1402.04 feet; thence North 20 degrees 24 minutes East a distance of 949.7 feet; thence North 36 degrees 48 minutes West a distance of 926.0 feet to a point hereby designated and hereafter referred to as "Point A"; thence South 53 degrees 12 minutes West a distance of 143.0 feet; thence South 36 degrees 48 minutes East a distance of 100.0 feet to the actual point of beginning of the line to be described; thence along a tangential curve to the right with a radius of 620.50 feet (delta angle 64 degrees 10 minutes, tangent distance 388.99 feet) a distance of 694.91 feet; thence South 27 degrees 22 minutes West along tangent to last described curve a distance of 100.0 feet; thence South 28 degrees 23 minutes 55 seconds West a distance of 570.39 feet to the termination of Line A, said point of termination being more particu- larly described as follows: Beginning at a point in the West line of the aforesaid Tract A, 139.3 feet North of the Southwest corner of Section 18, Township 117, Range 21; thence deflecting 83 degrees 37 minutes,20 seconds to the right and running Easterly 870 feet to the point of termination of said Line A; except that part thereof which lies North of the following described line 1 and East of the following described line 2: Line 1: Commencing at the aforedesignated "Point A"; thence North 36 degrees 48 minutes West a distance of 108.01 feet to the actual point of beginning of Line 1; thence West a distance of 729.16 feet and there terminating. Line 2: Commencing at the termination of the aforedescribed line 1; thence North a distance of 250.0 feet and there terminating. For the purpose of this description the South line of the Southwest Quarter of said Section 18 shall be designated as a line bearing North 88 degrees 40 minutes East. which lies Westerly, Southerly, and Northerly of the following described line: Beginning at the intersection of the North line of said Tract A with the above described Line 2: thence Southerly along said Line 2 to -2- the intersection with the above describedTine 1; thence -Easterly along said line 1 a distance of_351.48 feet;. thence Southeasterly 110.54'feet along a non=tangential curve, concave to the:Southwest, having a radius of 1753.86 feet and a'central-angle-of 3 -degrees 36 minutes 46 seconds, the chord -6f said curve -bears:-South _25 degrees 32 minutes, 13 seconds East; - thence_ South 88 degrees 28 minutes 16 -seconds West, not tangent to last described curve, -356.48 feet; thence North 2 degrees 26 minutes 48 seconds West, 10.00 feet; thence South 88 degrees 28 minutes 16 seconds West, 17:33- feet;' thence Southwesterly 50.77 feet along -a tangential curve,-concave'tothe Southeast, having a radius -of 50.83 feet and a central angle,ofr57 degrees -T3 minutes 05 seconds; thence - Southerly 69.97 feet along a non-tangential curve, concaveto the West, having a radius of:55:00 feet and a central angle of 72•degrees 53 minutes 43 seconds, the chord of -said curve bears South 5 degrees 53 minutes 39 seconds West; thence South 1 degree East, not tangent to last -described curve, 100:19 feet;' thence:Southwesterly 73.16 feet along-a:tangential curve, -concave to the'West,-having a radius of 419.79 feet and a central -angle ofl9-degr,ees!-59 minutes 09 seconds; thence:South,28 degrees 53 minutes, -.03 seconds,West, not tangent to last described curve, -52.14 -feet; thence South 77 degrees 36 minutes_East„ 109.91 feet; thence Easterly -76.53 feet=along a tan- gential -curve, concave to the North, having a radius of 322.94 feet and a central angle of 13 degrees"24 minutes; thence - South 1 degree East, not tangent to last described curve, -401.61 feet; thence South 29 degrees West, 261.52 feet; thence -South 76 degrees West, 170.00 feet; thence Northerly 63.25 •feet,a"long .a ,non-tangential -curve, concave to the East, having a radius -of 201.34 feet'and=a central angle of 18 degrees, the chord of said curve bears North -5 -degrees West; thence South 89 degrees West; not tangent to last described curve,, 236.30 feet to the,West line of the Southwest of said Section 18 and°there termin- ating. Coriclusion 1. Resolution'No. 6321 is hereby repealed. 2. The proposed final plat'of Lohman's Amhurst is' hereby approved and accepted by the City as being in accord and conformity with=all, ordinances, City plans and regulations of the -City of St. Louis Park and thelaws of the State of Minnesota, subject to the following conditions: a. Acceptance of the Subdivision -contract and bond or other surety as,provided by Section 14-309,(2) of the'St. Louis Park Ordinance Code by the City -Attorney -and the•,City Finance Director. b. Compliance with all terms and condittons the' -Special Permit granted by Resolution No -6320. 3. The City Clerk is hereby directed to file=a certified Copy'of thi-s Resolution in the Office of the Register of Deeds andrRegistrar of Titles for their use as required by M.S.A. 471.29. -3- 4. The City Clerk is hereby directed to supply a certified copy of this Resolution to the above-named owner and subdivider, who is the applicant herein. 5. The Mayor and City Manager are hereby.authorized to execute all contracts required herein, and the City Clerk is hereby directed to execute the certificate of approval on behalf of the City Council upon the said plat when all of the conditions set forth in Paragraph No. 1 above and Section 14-303(3)(e) of the St. Louis Park Ordinance Code have been fulfilled. 6. Such execution of the certificate upon said plat by the City Clerk, as required under Section 14-303(3)(e), shall be conclusive showing of proper compliance therewith by the subdivider and City officials charged with duties above-described and shall entitle such plat to be placed on record forthwith without further formality.
