RESOLUTION NO. 6538
A RESOLUTION RELATING TO THE CONDEMNATION
ACTION ENTITLED CITY OF ST. LOUIS PARK V. ALMOR, ET AL
BE IT RESOLVED by the City Council of St. Louis Park, Minnesota:
1. The City has previously made numerous efforts to work with
The Almor Company and Cardinal Insulated Glass Company to negotiate a
permanent access to their property.
2. In the condemnation action entitled City of St. Louis Park v.
Almor, Cardinal Glass, et al, File No. C-1425, Almor and Cardinal, in
disregard of these efforts, asserted that the City had denied them access
to their property, claiming damages for a diminution in value alleged to
have resulted.
3. On March 24, 1980, the Council adopted Resolution No. 6525 to
reassure Cardinal that if it wanted access from the City, the City and the
railroad stood ready and willing to consummate an agreement for access.
The resolution repeated the City's position that Cardinal could not both
claim damages for a denial of access and still expect the City to offer
alternative access.
4. Almor and Cardinal did not respond affirmatively to this willing-
ness to finalize their access, To the contrary, Cardinal and Almor continued
pursuing substantial damages for denial of access.
5. The City's attempts to work out permanent access having been
rejected by Cardinal and Almor in favor of treating their property as with-
out permanent access, the City hereby accepts that position by Cardinal and
Almor and asks City staff to discontinue further efforts to provide access.
