LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT THE CONSTRUCTION OF AN OFFICE BUILDING, PARKING RAMP AND RETAIL SPACE FOR PROPERTY LOCATED IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT AT 4900-4916 EXCELSIOR BOULEVARD BE IT RESOLVED by the City Council of St. Louis Park: Findings 1. V. R. Rooney has made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code for the purpose of construction of an office building, parking ramp and retail space for property located at 4900-4916 Excelsior Boulevard for the legal description as follows, to -wit: The Northeasterly Ninety and Eighteen Hundredths (90.18) Ceet as measured at right angles to the Northeasterly line thereof oC the following described tract of land. ' All that part of. the Northeast Quarter (NE4) oC the Northwest Quarter (NW4) of Section Seven (7), Township Twenty -Eight (28) North, Range Twenty -Four (24) West of the 4th Principal Meridian, described as follows: Beginning at the point of intersection of the Northwesterly right of way line of Excelsior Avenue with the West line of said Northeast Quarter (NE4) of the Northwest Quarter (NW4): thence running Northeasterly along said Northwesterly right of way line One Hundred One and Thirty-five hundredths (101.35') feet to the actual point of beginning of the tract of land to be described; thence deflecting to the left Eighty -Nine Degrees Fifty - Five Minutes (89°55') and running Northwesterly Two Hundred Thirty-four and Twelve Hundredths (234.12') feet, more or less, to a point in the West line of said Northeast Quarter (NE4) of the Northwest Quarter (NW4); thence running North along said West line Twenty-eight and Twenty-two Hundredths (28.22') Ceet, more or less, to a point in a line drawn parallel with and Three hundred Ten (310') Feet Northwesterly from the centerline of Excelsior Avenue as measured at right angles to said centerline; thence Northeasterly parallel with said centerline One Hundred Thirty-eight and Six Tenths (138.6') feet, more or less, to a point in a line erected perpendicular to the centerline oC Excelsior Avenue from a point in said centerline, which point is Two Hundred Seventy-three and Twenty -Five Hundredths (273.25') Feet Northeasterly from the point of intersection of said centerline with the West line of said Northeast Quarter (NE4) of the Northwest Quarter (NW4) as measured along said centerline; thence running Sourt-heasterly along said perpendicular line Two Hundred Sixty (260') feet to a point in the Northwesterly right of way line of Excelsior Avenue; thence running Southwesterly along said Northwesterly right of way line One Hundred Fifty and Eighteen Hundredths (150.18') feet to the actual point of beginning, Excluding portion taken for streets. Ali that part of the Northeast: 1/4 of the Northwest 1/4 of Section 7, Township 28 North, Range 24, West of the 4th Principal Meridian, described as follows: Beginning at the point of intersection of the Northwesterly right of way line of Excelsior Avenue with the West line of said Northeast 1/4 of the Northwest 1/4; thence running Northeasterly along said Northwesterly right of way line 101.35 feet to the actual point of beginning of the tract of land to be described; thence deflecting to the left 89 Degrees 55 Minutes and running Northwesterly 234.12 feet, more or less, to a point in the West line of said Northeast 1/4 of the Northwest 1/4; thence running North along said West I i ne 28.22 Feet, more or less, to a point in a line drawn parallel with and 310 Feet Northwesterly From the center line of Excelsior Avenue as measured at right angles to said centerline; thence Northeasterly parallel with said center- line 48.42 feet, more or Tess, to a point in a line erected perpendicular to the centerline of Excelsior Avenue from a point in said centerline, which point is 183.07 feet Northeasterly from the point of intersection of said centerline with the West line of said Northeast 1/4 9f the Northwest 1/4 as measured along said centerline; thence running Southeasterly along said perpendicular line 260 feet to a point in the Northwesterly right of way line of Excelsior Avenue; thence running Southwesterly along said Northwesterly right of way line 60 feet to the actual point of beginning. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 80 -O1 -SP) and the effect of the proposed construction of am office building, parking ramp and retail space on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed construction of an office building, parking ramp and retail space will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed construction of an office building, parking ramp and retail space is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit construction of an office building, parking ramp and retail space at the location described is granted based on the findings set forth above and subject to the following conditions: - 2 1. That the site be developed, used and maintained in accordance with Exhibit 1, Utility Site Plan; Exhibit 2, Ramp/Landscaping, Basement and First Floor; Exhibit 3, Ramp, Typical Floor and and Roof Plan; Exhibit 4, Office, Landscaping, Basement and First Floor Plan; Exhibit 5, Office Typical Floor Plan; Exhibit 6, Office Roof Plan; Exhibit 7, Ramp Elevations; and Exhibit 8, Office Elevations except as modified by the conditions which follow. 2. That the use be limited to 1) an office with a gross floor area not to exceed 195,200 net square feet with a 102 parking stalls; 2) a parking ramp on the west side of Quentin Avenue to contain at least 696 or more off-street parking spaces and no more than 1,700 net square feet of commercial or office space; 3) that at least 76% of the parking requirement be met. 3. That the parking ramp be constructed and opened simultaneously with the office building. 4. That prior to issuance of a construction permit and prior to commencement of construction of either the office building or the parking ramp, a covenant prohibiting the individual sale of the parking ramp and the office building be filed with the covenant running with the two properties for a period of no less than 25 years. 5. That a building permit not be issued for any portion of the site until final construction plans of the parking ramp and office building have been presented. Both permits must be issued simultaneously with construction of the ramp to proceed concurrently with construction of the office building. 6. That the applicant and his successors or assigns agree to pay the pro -rata share of any public parking, if provided, which benefits subject property. 7. That all rooftop equipment be screened. 8. That all loading and trash be kept inside at all times and that no outdoor storage be permitted of any material or equipment. 9. That the applicant execute a suitable agreement to use the air rights over Quentin Avenue prior to commencement of construction and prior to issuance of a construction permit. 10. That the applicant execute a Contract for Development as required in the urban renewal area. 11. That the applicant agree that all acquisition, demolition, reloca- tion, if any, development and financing is the responsibility of the developer. 12. That all exterior precast concrete and exposed exterior columns be designed and finished as exposed aggregate and that the screening on the parking ramp be anodized aluminum. - 3 13. That the plans submitted for purposes of obtaining a construction permit provide at least 76% of the required parking spaces and that the net and gross floor areas be calculated prior to issuance of a construction permit to insure such standard is met. 14. That the parking bay or loading bay as shown on the west side of Quentin Avenue be eliminated since no parking or loading is to be provided or allowed on Quentih Avenue. 15. That the applicant concurs and understands that Quentin Avenue, Excelsior Boulevard, 38th Street, and 39th Street are to be signed to prohibit all on -street parking. 16. That all development as shown on the approved exhibits, including buildings, skyways, parking, striping, landscaping, walkways, exterior materials, and the like be completed by July 15, 1982. 17. That a fee not be charged for parking in the parking ramp when such parking is used by employees, tenants, customers or others doing business in the six story office building included in this permit or in the 3,400 square feet of commercial space included in the parking ramp building.
