THE CITY COUNTY ON JANUARY 2, 1979 GRANTING PERMIT UNDER SEC-
TION 14-195(1) AND SECTION 14-195(3) OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO PERMIT A COMMERCIAL
DEVELOPMENT UNIT AND RESIDENTIAL DEVELOPMENT UNIT FOR PROPERTY
LOCATED IN THE B-2 BUSINESS DISTRICT AND R -B RESIDENTIAL BUSI-
NESS DISTRICT IN SHELARD PARK
BE IT RESOLVED BY the City Council of St. Louis Park:
Findings
1. Shelard Companies, Inc. has made application to the City Council
for an amendment to an existing special permit under Sections 14-195(1) and
14-195(3) of the Ordinance Code for the purpose of permitting a residential
development unit and commercial development unit for property located in the
B-2, Business District, and R -B, Residential Business District, having the
following legal description, to -wit;
All of the lots and blocks in Shelard Park.
2. The City Council has considered the advice and recommendation of
the Planning Commission (Case No. 79 -21 -SP) and the effect of the proposed
amendment to the existing special permit on the health, safety and welfare of
the occupants of the surrounding lands, existing and anticipated traffic conditions,
the effect on value of properties in the surrounding areas and the effect of
the use on the Comprehensive Plan and compliance with the intent of the Zoning
Ordinance and the general plan for Shelard Park.
3. The City Council has determined that the proposed amendment to the
existing special permit will not be detrimental to the health, safety or general
welfare of the community, nor will it cause serious traffic congestion nor
hazards, nor will it seriously depreciate surrounding property values, and the
proposed amendment is in harmony with the general purpose and intent of the
Zoning Ordinance, the Comprehensive Plan, and the general plan for Shelard Park.
Conclusion
A special permit amending the existing special permit for Shelard Park is
granted based on the findings set forth above and subject to the following
conditions:
1. The site shall be developed, used, and maintained in accordance with
the following exhibits: Exhibit A, Site Plan; Exhibit B, Final Plat
of Shelard Park; Exhibit C, Rendering; Exhibit D, Front Elevation of the
28 -story highrise; Exhibit E, Grading and Drainage Plan; and Exhibit F,
Utility Plan, except as the exhibits may be hereinafter modified or
modified by the conditions under the plat.

41. A condominium development consisting of six buildings and a total
of 48 units shall be permitted on Lot 3, Block 3, Shelard Park in
accordance with the following conditions:
a. That the site be developed used and maintained in accord-
ance with Exhibit XXX, Site Plan, PA1; Exhibit YYY, Ground
Floor Plan, PA?; Exhibit ZZZ, Upper Floor Plan, PA3, Exhi-
bit AAAA, Elevations, PA4; and Exhibit WWW, Planting Plan.
b. That the trees proposed along the westerly lot line be in
a separated area delineated by curbing and the base to be
landscaped.
c. That provisions be provided for watering the sod and
landscape features in the open -space areas by either
providing outside water facilities adjacent to the building
or some form of water supply to these areas.
d. That the trash container facilities be totally integrated
with the architecture of the building and garages, and that
such areas provide for total enclosures of such trash
facilities.
e. That the street trees required under the subdivision ordi-
nance be planted on or before November 1, 1979.
f. That all construction, building, landscaping, parking area,
garages, and other elements contained on the exhibits be
completed by June 15, 1980.
42. A Class III Restaurant containing no more than 2,295 square feet
be permitted in the existing eight story office building located
on Block 8, Shelard Park.
43. That the General Plan for Shelard Park, as identified in Condi-
tion 1 and titled Exhibit A, Site Plan, and as identified and
modified in Condition 35 is hereby superseded by the General
Site Plan, Exhibit A-1, subject to the following conditions:
a. That proper setbacks be provided and maintained along
all lot lines of Parcel 7 consisting of landscaped
berms with coniferous and deciduous trees, lower
level shrubbery, and augmented by an automatic watering
system. Said setback and landscaping to be reviewed at
the time of the special permit for Parcel 7. (the hotel
site).

b.
ATTEST:
Lighting on the site for the hotel shall be designed
so that all rays are directed perpendicular to the
ground and no rays shall be visible from off the
site. Light standards shall be no more than 25 feet
high and°shall be compatible with residential useiof
a high density type taking into account lower densi-
ties nearby.
