LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT THE OPERATION OF A CLASS II RESTAURANT LOCATED IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT, AT 5009 EXCELSIOR BOULEVARD. BE IT RESOLVED BY the City Council of St. Louis Park: Findings 1. Helen Mee-Yone Chan has made application to the City Cpuncil for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code for the purpose of operating a Class II Restaurant of 1,300 gross square feet and 426 net square feet on property located at 5009 Excelsior Boulevard for the legal description as follows, to -wit: Beginning at the intersection of the center line of Excelsior Avenue and the center line of Wooddale Avenue; thence northeasterly along said center line of Excelsior Avenue 831 feet; thence southeasterly at right angles 350 feet; thence northeasterly at right angles 70 feet; thence southeasterly at right angles to the northwesterly line of Block 1, Brookview Addition; thence southwesterly along the northwesterly line of said Block 1 to the center line of Wooddale Avenue; thence northwesterly to beginning except the roadways. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 80 -08 -SP) and the effect of the proposed Class I Restaurant, and discussed the possibility of a Class II Restaurant, on the health, safety, and welfare of the occupants of the surrounding lands existing and an- ticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed Class II Restaurant will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed Class II Restaurant is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. o IP Conclusion The special permit to permit the operation of a ClassII Restaurant at the loca- tion described is granted based on the findings set forth above and subject to the following conditions: 1. The site shall be developed in accordance with Exhibit A, Floor Plan, except as modified by the following conditions. 2. That there be no outdoor storage of trash or materials --all trash and storage shall be indoors and the trash storage area enlarged to meet the requirements of the Inspectional Services Department. 3. That all work be completed by June 15, 1980 or prior to issuance of a Certificate of Occupancy. Adopted by the City Council February 4, 1980.
