LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT THE OPERATION OF A CLASS I RESTAURANT (WITH ON -SALE WINE ONLY) FOR PROPERTY LOCATED IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT AT 4600 EXCELSIOR BOULEVARD. BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Nicholas Homan has made application to the City Council for a special permit under Section 14-124.100 of the St. Louis Park Ordinance Code for the purpose of permitting the operation of a Class I Restaurant (with on -sale wine only) located at 4600 Excelsior Boulevard for the legal description as follows, to -wit: Lots 8, 9, and 10 and also easterly 20 feet of Lot 11, Minikanda Vista 2nd Addition 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 79 -101 -SP) and the effect of the proposed Class I Restaurant (with on -sale wine only) on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed Class I Restaurant (with on -sale wine only) will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed Class I Restaurant is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a Class I Restaurant (with on -sale wine only) at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be used and maintained in accordance with Exhibit A. 2. The square feet in public and non-public area not be altered. 3. The applicant and their successors and assigns agree to pay their prorata share of any publicly assigned parking spaces. 4. On -sale wine shall be the only intoxicating liquor allowed to be sold on the premises, and the net floor area shall not exceed 3,000 square feet and the gross floor area 3,125 square feet.
