LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT ONE ADDITIONAL APARTMENT AND THE ELIMINATION OF 11 PARKING SPACES FOR AN EXISTING 130 UNIT APARTMENT BUILDING LOCATED IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT, AT 4820-60 WEST 39th STREET BE IT RESOLVED BY the City Council of St. Louis Park: Findings 1. Robert T. Kueppers on behalf of Mutual Development Corporation has made application to the City Council for a special permit under Section 14- 124.101(2) of the St. Louis Park Ordinance Code for the purpose of construct- ing one additional apartment and eliminating 11 parking spaces to an existing 130 unit apartment building located at 4820-60 W. 39th Street for the legal description as follows, to -wit: Commencing at the NW corner of NE4 of the NW4, thence East along N line thereof 519 12/100 feet, thence S to a point distant 284 97/100 feet N. from Northwesterly line of Excelsior Boulevard, thence Southwesterly parallel with the Northwesterly thereof to W. line of NE4 of NW4, thence N. to beginning except roads 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 79 -63 -SP) and the effect of the proposal on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehen- sive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed reduction of parking will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed reclamation of land by filling is in harmony with the general purpose and ' intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The Special Permit to permit one additional apartment and eliminate 11 parking spaces at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the development to be undertaken be done in accordance with Exhibit A, Site Plan as revised and Exhibit B, Remodelling Plan. 2. That the entrance to the front parking lot be revised by increasing the distance between the planting island and the driveway curbing and by using a longer radius on the curbing from the property line to the parking lot. 3. That the applicant recognize that granting the permit does not diminish his responsibility to provide adequate parking. If the parking demand for the site exceeds the number of available spaces, the 11 parking spaces removed by this special permit shall, or a portion thereof as determined by need, shall be restored. The applicant further recognizes that on -street parking on 39th Street is subject to removal by the City at any time. 4. All landscaping, repairs, parking lot striping and apartment construction shall be completed by May 15, 1980.
