A RESOLUTION GRANTING PERMIT UNDER SECTION 14-124 OF
THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING
TO PERMIT CONSTRUCTION OF A WAREHOUSE ON PROPERTY
LOCATED IN THE DDD, DIVERSIFIED DEVELOPMENT DISTRICT,
AT 5340 WEST 23rd STREET.
BE IT RESOLVED BY the City Council of St. Louis Park:
Findings
1. The Delmark Company, Incorporated, has made application to the City
Council for a Special Permit under Section 14-124 of the St. Louis Park
Ordinance Code for the purpose of constructing a warehouse on property located
at 5340 West 23rd Street for the legal description as follows, to -wit:
Beginning at the northwesterly corner of Lot 2, Blgck
1, Delmark's First Addition, thence southwesterly parallel
with the center line of the railroad right of way to the
West line of Section 31, thence south to the northwest
corner of Tract A, Registered Land Survey No. 493, thence
northeasterly along the northerly line of said Tract A to
the westerly line of said Lot 2, thence northwesterly to
the point of beginning.
That part of Tracts A and B of Registered Land Survey No.
493 lying northerly of 23rd Street and westerly of Utica
Ave;ue and lying southwesterly of Delmark's First Addition,
except the road.
Lots 1 and 2, Block 1, Delmark's First Addition.
The east 900 feet of the north 1/2 of Government Lot 4
except the railroad land.
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 79 -93 -SP) and the effect of the proposed ware-
hogse on the health, safety, and welfare of the occupants of the surrounding
lands, existing and antjcipated traffic conditions, the effect on values of
properties in the surrounding area, the effect of the use on the Comprehensive
Plan, and compliance with the intent of the Zoning Ordinance.
3. The Council has determined that the proposed warehouse will not be
detrimental to the health, safety,or general welfare of the community nor will
it cause serious traffic congestion nor hazards, nor will it seriously
depreciate surrounding property values, and the proposed warehouse is in harmony
with the general purpose and intent of the Zoning Ordinance and the Comprehensive
Plan.
Conclusion
The special permit to allow construction of a warehouse at the location
described is granted based on the findings set forth above and subject
to the following conditions:
1. The site shall be developed, used and maintained in accordance
with Exhibit A, Site Plan and Exhibit B, Elevation Plan.
2. All improvements, including the warehouse addition and land-
scaping as shown on the exhibits, shall be completed by May 15, 1981.
