Findings
1. The Cheyenne Land Company through the Centurion Company, Inc. has made
application to the City Council for a special permit under Section 14-195(3)
of the Zoning Ordinance to permit a Residential Development Unit consisting
of 288 townhouses to be situated on property generally lying west of proposed
County Road 18 north of Highway 7, east of the west city boundary and south
of West 36th Street, commonly known as Lohman's Amhurst.
2. The City Council has considered the advice and recommendation,of the
Planning Commission (Case No. 78 -110 -SP) and the effect of the proposed
special permit on the health, safety and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect
on values of properties in the surrounding area, the effect of the use on
the Comprehensive Plan and compliance with the intent of the Zoning Ordinance.
3. The City Council has determined that the proposed special permit will
not be detrimental to the health, safety or general welfare of the community
nor will it cause serious traffic congestion nor hazards, nor will it
seriously depreciate surrounding property values, and the proposed special
permit is in harmony with the general purpose and intent of the Zoning
Ordinance and the Comprehensive Plan.
4. The City Council has determined that Resolutions No. 6363 and 6320, which
were previously enacted pursuant to this case, should be rescinded as a
result of the agreement reached between the Centurion Company and Neighbors
United for Responsible Development (NURD) in which the two parties agreed that
the petition requesting an Environmental Assessment Worksheet and an
Environmental Impact Statement would be withdrawn, and that the density of
the project would be reduced. In addition, the City of Hopkins has withdrawn
its request for a Metropolitan Significance Review of the Amhurst project.

for purposes of information.
