RESOLUTION NO. 6411
A RESOLUTION AMENDING RESOLUTION NO. 5201 GRANTING
PERMIT UNDER SECTION 14-156 OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO PERMIT
EXPANSION OF A CLASS I RESTAURANT FOR PROPERTY
LOCATED IN THE B-2, GENERAL BUSINESS DISTRICT, AT
9920 WAYZATA,BOULEVARD
BE IT RESOLVED BY the City Council of St. Louis Park:
Findings
1. Restaurants No Limit, Inc. has made application to the City Council
for a special permit under Section 14-156 of the St. Louis Park Ordinance
Code for the purpose of expanding a class I restaurant on 9920 Wayzata
Boulevard from 2196 -square feet to 3980 square feet for the legal description
as follows, to -wit:
All that part of the Southeast 1/4 of the Northeast
1/4 of Section 1, Township 117, North Range 22, West
of the Fifth Principal Meridian, described as follows:
Commencing at the Intersection of the North line of
Superior Boulevard with the West line of the Southeast
1/4 of the Northeast 1/4 of said Section 1; thence
north along the West line of said Southeast 1/4 of
the Northeast 1/4 a distance of 231 feet; thence
Easterly parallel with Superior Boulevard 315.25 feet;
thence south to a point on the North Line of Superior
Boulevard 315 feet Easterly from the point of begin-
ning; thence Westerly along the Northerly line of said
Boulevard 315 feet to beginning.
That part of the SE 1/4 of NE 1/4 of Section 1,
Township 117, Range 22, described as follows:
Parking lot east of building
Commencing on the North line of Superior Boulevard
at a point 315 feet Easterly from West line of said
SE1/4 of NE1/4 of said Section 1; thence North 231
feet to a point 315.25 feet Easterly from a point
on West line of said SE1/4 distant 231 feet North
of the North line of Superior Boulevard; thence
Easterly parallel with Superior Boulevard 315.25
feet; thence South to a point on the North line of
Superior Boulevard 315 feet Easterly of point of
beginning; thence Westerly 315 feet to beginning;
1FSS that portion, if any, taken for Trunk Highway
No. 12, except that the easterly 65 feet of the
site used for office is excluded.
2. The City Council has considered the advice and recommendation of
the Planning Commission (Case No. 79 -78 -SP) and the effect of the proposed
land reclamation by filling on the health, safety, and welfare of the
occupants of the surrounding lands, existing and anticipated traffic
conditions, the effect on values of properties in the surrounding area,
the effect of the use on the Comprehensive Plan, and compliance with the
intent of the Zoning Ordinance.
3. The Council has determined that the proposed expansion will not be
detrimental to the health, safety or general welfare of the community nor
will it cause serious traffic congestion nor hazards, nor will it seriously
depreciate surrounding property values, and the proposed expansion is in
harmony with the general purpose and intent of the Zoning Ordinance and the
Comprehensive Plan.
Conclusion
The special permit to permit expansion of a class I restaurant from 2196
square feet to 3980 square feet at the location described is granted based
on the findings set forth above and subject to the following conditions.
1. That the site be developed, used and maintained in
accordance with Exhibit A - Site Plan, Exhibit B -
Elevation Plan, and Exhibit C - Floor Plan,
except as modified by the following conditions:
2. That all trash and garbage be stored entirely
within the building.
3. That all lighting be directed perpendicular to the
parking lot or surface of the ground, and designed
in such a way so that no rays on the site, including
all parking lot areas, are directed toward the
highway, roadways, or abutting development.
4. That all improvements including buildings, land-
scaping, parking, and other features and requirements
