A RESOLUTION GRANTING PERMIT UNDER SECTION 14-156(18)
OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING
TO PERMIT A MINOR AUTOMOBILE REPAIR FACILITY FOR
PROPERTY LOCATED IN THE B-2 DISTRICT AT 6009 WAYZATA
BOULEVARD.
BE IT RESOLVED BY the City Council of St. Louis Park:
Findings
1. The G. T. Mork Co. and the Federal Bureau of Investigation have made
application to the City Council for a Special Permit under Section 14-156(18)
of the St. Louis Park Ordinance Code for the purpose of operating a minor
automobile repair facility in a B-2 District at 6009 Wayzata Boulevard for the
legal description as follows, to -wit:
Lots 25 and 26, Block 1, "John A. Johnsons Addition",
except that part taken by State Highway Number 12 and
all that part of Lots 27 and 28, Block 1, "John A.
Johnsons Additon" lying Northwesterly of a line drawn
parallel to and 20 feet Westerly (measured at right
angles) from the Southeasterly line of said Lots
except that part taken by State Highway Number 12,
also that portion of the Northerly 1/2 of 14th Street
now vacated, lying between extensions across it of
the West line of said Lot 25 and a line drawn parallel
to and 20 feet Northwesterly from the Southeasterly
line of said Lot 27.
That part of Lot 22, Block 1, "John A. Johnsons
Addition", described as follows: Beginning at the
intersection of the East line of said Lot 22 with the
Minnesota State Highway No. 12; thence South on said
line 120 feet; thence West to a point in the West
line of said Lot 22, which is 120 feet South of the
intersection of the West line of said Lot 22 with
State Highway No. 12; thence North on said West
line of said Lot 22, 120 feet to the intersection
with State Highway No. 12; thence East to the point
of beginning.
Lots 23 and 24, Block 1, "John A. Johnsons Addition".
Except that part taken for State Highway No. 12.
Lot 1, Block 4, "John A. Johnsons Addition" except the
West 10 feet front and rear of the North 125 feet
thereof, also that portion of the Southerly 1/2 of 14th
Street now vacated lying between extensions across it
of the West line of said Lot 1 herein described, and
the Southeasterly line of said Lot 1; and all of Lot 2,
Block 4, "John A. Johnsons Addition" except the north
125 feet thereof.
The West 10 feet front and rear of the North 125 feet
of Lot 1 and that part of the Southerly 1/2 of 14th
Street now vacated lying between the extensions across
it of the West line of said Lot 1 and of the East line
of the West 10 feet of said Lot 1 and the North 125
feet of Lot 2, Block 4, "John A. Johnsons Addition".
Lots 3 and 4, except the South 125 feet thereof, Block
4, "John A. Johnsons Addition".
2. The City Council hos considered the advice and recommendation of the
Planning Commission (Case No. 79 -71 -SP) and the effect of the proposed minor
automobile repair facility on the health, safety, and welfare of the occupants
of the surrounding lands, existing and anticipated traffic conditions, the
effect on values of properties in the surrounding area, the effect of the use
on the Comprehensive Plan, and compliance with the intent of the Zoning
Ordinance.
3. The Council has determined that the proposed minor automobile repair
facility will not be detrimental to the health, safety or general welfare of
the community nor will it cause serious traffic congestion nor hazards, nor
will it seriously depreciate surrounding property values, and the proposed
minor automobile repair facility is in harmony with the general purpose and
intent of the Zoning Ordinance and the Comprehensive Plan.
Conclusion
The Special Permit to permit a minor automobile repair facility at the location
described is granted based on the findings set forth above and subject to the
following conditions:
1. No vehicles shall be kept or stored outside the building.
2. All trash and refuse shall be kept in an enclosed refuse room
within the building which is protected by an automatic fire
suppression device.
3. Waste oil and lubricants shall be disposed of off-site
in an approved manner.
4. There shall be no outside storage on the site. All work,
servicing and repair shall occur within the building.
5. A door shall be installed between the radio repair office
and the adjacent office.
6. Use of the premises shall be limited to minor automobile
repair for the FBI only and it shall not be open to the
public.
7. All conditions as set forth in the special permit granted
by Resolution No. 6198 shall remain in full force and
effect.
