LOUIS PARK ZONING'ORDINANCE FOR ALLOWING EGRESS OVER EXISTING DRIVEWAY, TO CORRECT THE LEGAL DESCRIPTION BE IT RESOLVED BY the City Council of St. Louis Park: Findings: 1. Dora Sue Rubel has made application to the City Council for permit under Section 6:092 of the St. Louis Park Zoning Ordinance for the purpose of providing an extension of a driveway between a parking area on the east side of the Brittany Apartments and Salem Avenue for the legal description as follows, to -wit: Lots 8 to 17 inclusive, Block 6, Latham's Minnetonka Boulevard tract and all of Lot 1, Block 1, Forsberg's Addition and that part of Lot 7, Block 6, Latham's Minnetonka Boulevard tract lying south of the northerly 12 feet thereof 2. The Council has considered the advice and recommendation of the Planning Commission (Case No. 70-58-S.P.) and the effect of the proposed use on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, including parking facilities on adjacent streets, and the effect on values of properties in the surrounding area, and the effect of the proposed use on the Comprehensive Plan. 3. The City Council of the City of St. Louis Park has determined that the said proposed use will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion, nor hazards, nor will it seriously depreciate surrounding property values; and the same is in harmony with the general purpose and intent of this ordinance and the Comprehensive Plan, and Conclusion: The special permit to permit the extension of a driveway from the east side of the Brittany Apartments to Salem Avenue at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site, including lots 8-17 inclusive, Block 6, Latham's Minnetonka Boulevard Tract and all of Lot 1, Block 1, Forberg's Addition and that part of Lot 7, Block 6, Latham's Minnetonka Boulevard Tract lying south of the northerly 12 feet thereof, shall be developed, used and maintained in accordance with Exhibit "D", Site Plan - Landscape Plan except as modified by the following: a. The precast concrete curbing shown on Exhibit "D" shall be placed contiguously and anchored with steel pins driven into the ground. The curbing shall be 6 inches in height and the landscaped area shall be backfilled to the top of the curb on both the north and south side of the driveway. b. The landscaped areas shall be filled with black dirt and sodded, and it shall be planted with four Green Ash, 2 inches in diameter; ten American Aborvitae, 4 feet high at the time of planting; three Blue Spruce 6 feet in height at the time of planting; and two Evergreen trees at least 4 feet in height at the time of planting; as shown on Exhibit "D". c. The driveway shall be one-way east bound to Salem Avenue and a stop sign and "do not enter" sign shall be placed at the west line of the sidewalk at the intersection of the driveway and the sidewalk. d. All parking is limited to the parking lots as shown on the plan. Parking is prohibited on the driveway and landscaped area. e. A fire hydrant shall be placed along or near the driveway as required by the Department of Public Works. Adopted by the City Council August 27, 1979.
