A RESOLUTION GRANTING PERMIT UNDER SECTION 14-124 OF
THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING
TO PERMIT A VETERINARY CLINIC FOR PROPERTY LOCATED IN
THE DIVERSIFIED DEVELOPMENT DISTRICT AT 5305 CEDAR LAKE ROAD
BE IT RESOLVED BY the City Council of St. Louis Park:
Findings
1. Affiliated Emergency Veterinary Services has made application to the
City Council for a special permit under Section 14-124 of the St. Louis Park
Ordinance Code for the purpose of permittingra veterinary clinic for property
located at 5305 Cedar Lake Road for the legal description as follows, to -wit:
Beginning at a point in the Southeasterly line of Cedar Lake Road
distant 532.54 feet Southwesterly measuring along said Southeasterly
line from its intersection with the Westerly line of State Highway
No. 100; thence South 14 degrees 21 minutes 30 seconds East 40.73
feet; thence Southeasterly on a tangential curve to the left with
a radius of 449.37 feet a distance of 124.41 feet; thence Southerly
on a reverse curve to the right with a radius of 467.37 feet a
distance of 108 feet; thence South 82 degrees 45 minutes 20 seconds
West a distance of 290.58 feet; thence at a right angle Northerly to
the center line of Cedar Lake Road; thence Northeasterly along said
center line to an intersection with a line bearing North 14 degrees
21 minutes 30 seconds West from the point of beginning; thence South
14 degrees 21 minutes 30 seconds East to the point of beginning.
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 79 -24 -SP) and the effect of the proposed veteri-
nary clinic on the health, safety, and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect
on values of properties in the surrounding area, the effect of the use on
the Comprehensive Plan, and compliance with the intent of the Zoning Ordi-
nance.
3. The Council has determined that the proposed veterinary clinic will
not be detrimental to the health, safety or general welfare of the community
nor will it cause serious traffic congestion nor hazards nor will it seriously
depreciate surrounding property values, and the proposed veterinary clinic is
in harmony with the general purpose and intent of the Zoning Ordinance and
the Comprehensive Plan.
Conclusion
The special permit to permit a veterinary clinic at the location described
is granted based on the findings set forth above and subject to the following
conditions:
1. That the site be developed, used, and maintained in
accordance with Exhibit A, Site Plan; Exhibit B,
Floor Plan; and Exhibit C, Miscellaneous Information
regarding Site Plan Development, except as modified
by the Planning Department on April 17, 1979.
2. All walls, ventilation, and utilities and facilities
serving the development be designed to prevent any
nuisances being transmitted through the walls, ceiling
or openings to abutting property or to abutting tenants
in the building.
3. No animal shall be kept out-of-doors nor shall any
animal be allowed out-of-doors as part of the special
permit use.
4. There shall be boarding or keeping of animals. No
animal shall remain on the premises for more than
24 hours between 6:00 a.m. on Monday and 6:00 p.m.
on Friday nor shall any animal be kept for more than
48 hours between 6:00 p.m. on Friday to 6:00 a.m. on
Monday.
5. This permit shall be for approximately eighteen months.
It shall terminate on November 1, 1980.
6. The use and occupancy of the structure must conform
to the City's ordinances and building codes governing
such use.
7. The improvements shall be completed by June 15, 1980.
