HomeMy WebLinkAbout6250 - ADMIN Resolution - City Council - 1979/04/16APRIL 16, 1979 8c RESOLUTION NO. 6250 RESOLUTION AND ORDER FOR REMOVAL OF SUBSTANDARD STRUCTURE LOCATED AT 4215 EXCELSIOR BLVD. AS A HAZARDOUS BUILDING WHEREAS, pursuant to Chapter 393 of the Laws of Minnesota, 1965, and Chapter 324 of the Laws of Minnesota, 1967, (M.S.A. 463.15-26) the Build- ing Official has filed his report on a two story frame building at 4215 Excelsior Boulevard, St. Louis Park, Minnesota, to -wit: Lots 1, 2, 3, 4 and 10, Block 4, Hankes' Minikanda Terrace and WHEREAS, the City is authorized to certify the expense of such demoli- tion as a special assessment against said lands in accordance with Section 463.21 of Minnesota Laws 1967, to be certified to the Hennepin County Finance Division, Special Assessments Unit, 606A Government Center, Minneapolis, Minnesota, in the manner of certification of special assess- ments for local improvements under Minnesota Statutes 1961, Sections 429.061 to 426.081, therefore BE IT RESOLVED by the City Council of the City of St. Louis Park: 1. That the City Council on the date of this resolution has duly heard and considered the matter and hereby finds and determines that the above described building upon the above described land is hazardous and substandard upon the following grounds: The following items of deficiency exist in the existing structure at 4215 Excelsior Blvd., under the Housing Code of the City of St. Louis Park, Chapter 10, Sections: B. Inadequate Sanitation: 1. Lack of plumbing fixtures. Due to fire damage all plumbing fixtures were either destroyed or rendered inoperative. 6. Lack of adequate heating facilities. Due to fire damage the heating system was either destroyed or rendered in- operative. 7. Lack or improper operation of required ventilation equip- ment. Fire damage destroyed all ventilation equipment. 10. Lack of required electrical lighting. Fire damage has destroyed all lighting. ir 1 1 C. Structural Hazards: 2. Defective or deteriorated flooring or floor supports. Fire damage has destroyed or rendered most of the flooring hazardous. 4. Members of walls, partitions, or other vertical supports have been rendered unsafe due to fire damage. 6. Members of ceilings, roofs, ceiling and roof supports or other horizontal members have been rendered unsafe due to fire damage. D. Nuisance: The entire site is deemed an attractive nuisance as defined in the Housing Code of the City of St. Louis Park, Chapter 4. E. Hazardous Wiring: The entire electrical system has been destroyed or rendered inoperative by fire. F. Hazardous Plumbing: The entire plumbing system has been destroyed or rendered inoperative by fire. G. Hazardous Mechanical Equipment: The entire heating and ventila- tion system has been destroyed or rendered inoperative by fire. H. Faulty Weather Protection: The entire structure has no weather protection due to fire damage. Extensive damage is being done due to water damage. K. Hazardous or Unsanitary Premises: The entire site, because of the debris, rat harborage, combustible materials, and similar materials or conditions constitute fire, health, or safety hazards. This entire structure has been damaged by fire and exposure to weather to the point that it exceeds 50% of the value of the existing building re- quiring the complete structure to conform to present Building Codes. This would require that all wood construction within the building be removed and replaced with fire resistive construction. 2. That pursuant to the foregoing and in accordance with Chapter 393 of the Laws of Minnesota, 1965, as amended, it is HEREBY ORDERED BY THE CITY COUNCIL OF THE CITY OF ST. LOUIS PARK that the above said hazardous building be razed or removed by the City Manager with City forces or by contractor, and 3. That is is further ordered by the Council that all personal property, if any be discovered, of a nature or value so as to be removed, it shall be removed and the Manager shall sell such personal property or fixtures at public auction. -2 4. That the City Manager, officers and employees of the City are further authorized and directed to take whatever action, prepare and sign such papers, orders and certificates necessary to comply with this order and to assess the costs thereof against the real estate, to be collected as special assessments.
