RESOLUTION NO. 6242
A RESOLUTION GRANTING PERMIT UNDER SECTION 14-181 OF THE
ST. LOUIS PARK ORDINANCE CODE RELATED TO A SPECIAL PERMIT
FOR A MOTOR FUEL STATION FOR PROPERTY LOCATED IN AN I-3,
INDUSTRIAL DISTRICT, AT 7000 WEST LAKE STREET.
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Park Tire and Auto Center has made application to the City Council
for a special permit under Section 14-181 of the St. Louis Park Ordinance
Code for the purpose of permitting expansion and modification of -a motor
fuel station located at 7000 West Lake Street for the legal description
as follows, to wit:
Lots 1, 2, 27, 28, 29 and 30, Block 187 and Lots 1, 2, 3, and
4, Block 336, Rearrangement of St. Louis Park, including ad-
jacent street and alley vacated, except that part taken for
Highway, also except that part of Lots 1 and 2, Block 336,
Rearrangement of St. Louis Park lying Easterly of a curved line
convex to the Northeast with a radius of 129 feet running
from a point on the Southeasterly line of said Lot 1, distant
36.35 feet Southwesterly of the most Easterly corner of said
Lot 1, to a point on the North line of said Lot 2, distant
43.85 feet West of the Northeasterly corner of said Lot 1,
according to the plat thereof on file and of record in the
office of the Register of Deeds in and for Hennepin County,
Minnesota, together with all rights, privileges and appurte-
nances thereto and all buildings and land improvements thereon;
but subject to all easements, rights-of-way, reservations,
restrictions and encumbrances of record, to any existing
tenancies, to all zoning laws and ordinances, and to any
state of facts an accurate survey or inspection of the
premises would show.
2. The City Council has considered the advice and recommendation of
the Planning Commission (Case No. 79 -16 -SP) and the effect of the proposed
motor fuel station on the health, safety and welfare of the occupants of
the surrounding land, existing and anticipated traffic conditions, the
effect on values of properties in the surrounding area, the effect of the
use on the Comprehensive Plan and compliance with the intent of the
Zoning Ordinance.
3. The Council has determined that the proposed motor fuel station
will not be detrimental to the health, safety or general welfare of the
community nor will it cause serious traffic congestion nor hazards, nor
will it seriously depreciate surrounding property values, and the proposed
motor fuel station is in harmony with the general purpose and intent of
the Zoning Ordinance and the Comprehensive Plan.

Conclusion
The special permit to permit a motor fuel station at the location described
is granted based on the findings set forth above and subject to the
following conditions:
1. The site shall be constructed, used and maintained in accordance
with Exhibit A, Site Plan, as modified to provide for landscaping
along the northerly side of the building.
2. The motor fuel station building shall be reconstructed in
accordance with Exhibit B, Elevation Plan, providing for
a public waiting area at the easterly side of the existing
building under the existing roof line.
3. There shall be no outside sales or display except that which
is permitted under the zoning ordinance and as shown on the
plan and such area shall not be greater than a total of
150 sq. ft. in area nor more than 5 ft. in height, including
any one or any combinations of such outside sale or display of
products
4. All parking shall he confined to the applicant's site and no
parking shall be allowed on city or highway right-of-way or
along the access road to Highway 7, nor shall there be any
parking or storage or display of materials in the set -back
areas.
5. All improvements, including building, painting, curbing and
landscaping shall be completed by August 1, 1979.
