HomeMy WebLinkAbout6220 - ADMIN Resolution - City Council - 1979/02/05February 5, 1979 11c RESOLUTION NO. 6220 RESOLUTION ESTABLISHING POLICY FOR CONSTRCUTION OF RETAINING WALLS ALONG CITY STREETS WHEREAS, a fair and uniform policy regarding construction and maintenance of retaining walls abutting City streets has been determined necessary; and WHEREAS, retaining walls are constructed in conjunction with street reconstruction as a result of slopes, vegetation and other physical limitations; and WHEREAS, it is the desire of the City Council to express its policy regarding retaining wall construction, maintenance and assessment thereof. that: ii THEREFORE, BE IT RESOLVED by the City Council of St. Louis Park Construction of Retaining Walls: 1. Where the finished elevation of the new street creates a situation whereby the new slope of the adjoining yard will be more severe than a slope of 3:1 within a ten foot area behind the curb (one foot rise in three feet of length - see the attached sketch) a retaining wall is installed if the property owner concurs. Otherwise the yard is shaped as adequately as is possible and sod is placed. 2. Where vegetation such as trees, bushes, or shrubbery are threatened by the shaping of the property owner's yard it is customary to attempt to save the vegeta- tion through the placement of a retaining wall. In these cases, the value of the vegetation is compared to the cost of the retaining wall. 3. Where other unusual situations such as fence replacement, severe property disruption, minimum parking lot setbacks, existing retaining walls, etc. are present, a retaining wall is considered. Maintenance Responsibilities Associated With Retaining Walls: 1. Retaining walls constructed on private property are a maintenance responsibility of the property owner and shall be assumed immediately upon completion of construction. 2. Retaining walls constructed on public street right of way shall be a maintenance responsibility of the abutting property owner upon expiration of the one year contractor guarantee period. Walls on public property constructed prior to the effective date of this resolution shall be the maintenance responsibility of the City of St. Louis Park. Assessments for the Construction of Retaining Walls: 1. When the criteria for retaining wall construction is met the cost of construction of the wall is assumed by the City. 2. If the criteria are not satisfied, but the property owner desires to have a retaining wall constructed, the owner must pay the difference between the cost of the retaining wall construction and the normal sod placement which the City would install at its expense.
