LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT A FOUR-STORY OFFICE BUILDING AND DRIVE-IN BANKING FACILITY FOR PROPERTY LOCATED IN THE P.U.D. PLANNED UNIT DEVELOPMENT DISTRICT AT 5333 WEST 39TH STREET. Findings 1. Reuben L. Anderson-Cherne, Inc. has made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code for the purpose of permitting a four-story office building with drive-in banking facilities located at 5333 West 39th Street for the legal description as follows, to -wit: That part of the Northwest Quarter of the Northwest Quarter of Section 7, Township 28, Range 24, described as commencing at the Northwest corner of said Northwest Quarter of the Northwest Quarter; thence South along the West line thereof 443.71 feet; thence East parallel with the North line of the actual point of beginning; thence West along said parallel line 488.66 feet; thence South parallel with the West line of said Northwest Quarter of the Northwest Quarter a distance of 200 feet; thence East parallel with the North line of said Northwest Quarter of the Northwest Quarter a distance of 304.9 feet; thence Southerly 113 feet, more or less, to a point which is 450.33 feet Northwesterly and on a line erected perpendicular to the center line of Excelsior Boulevard from a point on said center line distant 850.5 feet South- westerly along said center line from the East line of said Northwest Quarter of the Northwest Quarter; thence Northeasterly parallel with said center line 193.47 feet; thence Southerly to a point which is 318.44 feet Northwesterly and on a line erected perpendicular to the center line of Excelsior Boulevard from a point on said center line distant 713.69 feet Southwesterly along said center line from the East line of said Northwest Quarter of the Northwest Quarter; thence North to the actual point of beginning, except for the North 33 feet thereof. That part of the northwest one quarter of the northwest one quarter of Section 7, Township 28, Range 24, commencing at the northwest corner of Section 7; thence south 443.71', thence southerly 68' along the east line of State Highway 100 to the point of beginning of the tract to be described; thence east 126.5' to a point 487.71' south from the north line of Section 7; thence south 133.95'; thence deflecting 80 degrees, 24" to the right 104.73' to the easterly line of State Highway 100; thence northwesterly to the point of beginning, except for the highway. That part of the northwest one quarter of the northwest one quarter of Section 7, Township 28, Range 24, commencing at the northwest corner of the section, then south 836.91', thence north 76 degrees east, 140', thence north 133.4' to the actual point of beginning, thence continuing north 46.65', thence deflecting 99 degrees, 36" to the left, 104.73' to the easterly line of State Highway 100, thence southeasterly along said highway line 46', thence northeasterly to the point of beginning. That part of the northwest one quarter of the northwest one quarter of Section 7, Township 28, Range 24, commencing at a point 135.84' east from the west line, and 643.711 south from the north line of the northwest one quarter; thence south 24.05', thence deflecting 80 degrees, 24" right, 8.85' to the actual point of beginning; thence southeasterly at right angles 50', thence southwesterly at right angles 87.99' to the easterly line of Highway 100; thence northerly along said highway line 50', thence northeasterly to the point of beginning. That part of the northwest one quarter of the northwest one quarter of Section 7, Township 28, Range 24, commencing at a point 135.84' east from the west line, and 643.71' south from the north line of the northwest one quarter of the northwest one quarter of Section 7, Township 28, Range 24; thence south 24.05', thence deflecting 80 degrees, 24" right 8.85', thence southerly at right angles 50', thence southwesterly at right angles 87.99' to the easterly line of Highway 100; thence southeasterly along said highway line 52', thence northeasterly at right angles 132.23', thence northerly at right angles 120.5', thence west 31.5' to the point of beginning. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 78 -121 -SP) and the effect of the proposed four- story office building and drive-in banking facility on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed four-story office building and drive-in banking facility will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed four-story office building and drive-in banking facility is in harmony with the general purpose and intent of the Zoning Ordinance and the Cgmprehensive Plan. Conclusion The special permit to permit a four-story office building and drive-in banking facility at the location described is granted based on the findings set forth above and subject to the following conditions : 1. That the site be developed, used and maintained in accordance with Exhibit A, Elevation Plan, Exhibit B, Site Plan, Exhibit C, Grading and Utility Plan, Exhibit D, First Floor Plan, Exhibit E, Typical Upper Floor Plan and Exhibit F, North and East Elevation Plan, except as modified by the Planning Department on November 8, 1978, which includes additional sidewalk facilities. 2. All improvements, including the building, access, parking, sidewalk, landscaping and other elements contained on the exhibits, shall be completed by July 1, 1980.
