RESOLUTION NO. 6172
A RESOLUTION GRANTING PERMIT UNDER SECTION 14-124.101
OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING
TO PERMIT CONSTRUCTION OF A GREENHOUSE AND CONVERSION OF
A RETAIL STORE TO AN OFFICE BUILDING FOR PROPERTY LOCATED
IN THE P.U.D. PLANNED UNIT DEVELOPMENT DISTRICT AT
5300 EXCELSIOR BOULEVARD.
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Charles Nasby has made application to the City Council for a special
permit under Section 14-124.101 of the St. Louis Park Ordinance Code for the
purpose of constructing a greenhouse attached to an office building located
at 5300 Excelsior Boulevard for the legal description as follows, to -wit:
That part of the northwest quarter of the northwest quarter
of Section 7, Township 28, Range 24, described as commencing
at the point of intersection of the east line of said northwest
one quarter of the northwest one quarter with the center line
of Excelsior Boulevard, thence southwesterly along said center
line 850.5', thence at a right angle northwesterly 52' to the
actual point of beginning in the northwesterly right-of-way
line of Excelsior Boulevard, thence continuing northwesterly
along last described course 130', thence southwesterly
deflecting to the left 86 degrees, 53", a distance of 60',
thence southeasterly deflecting to the left 93 degrees, 07",
a distance of 130' to aforesaid right-of-way line, thence
northeasterly deflecting to the left 83 degrees, 53" along
said right-of-way line 60' to the point of beginning.
2. The City Council has considered the advice and recommendation of
the Planning Commission (Case No. 78 -123 -SP) and the effect of the proposed
greenhouse and office building on the health, safety and welfare of the
occupants of the surrounding lands, existing and anticipated traffic
conditions, the effect on values of properties in the surrounding area,
the effect of the use on the Comprehensive Plan and compliance with the
intent of the Zoning Ordinance.
3. The Council has determined that the proposed greenhouse and office
building will not be detrimental to the health, safety or general welfare of the
community nor will it cause serious traffic congestion nor hazards, nor will
it seriously depreciate surrounding property values, and the proposed greenhouse
and office building is in harmony with the general purpose and intent of the
Zoning Ordinance and the Comprehensive Plan.

Conclusion
The special permit to permit construction of a greenhouse and conversion
of a retail store to an office building at the location described is granted
based on the findings set forth above and subject to the following conditions:
1. The site shall be developed, used and maintained in accordance
with Exhibit A, Site Plan.
2. There shall be no outside storage of goods and materials,
including those related to greenhouse construction, docks, etc.
3. Signs shall not be located closer than 20 feet to the front
lot line, the total sign area shall be limited to 200 square
feet, and free-standing signs shall not exceed 15 feet in height.
4. The approval of this special permit does not authorize the
applicant to use the publicly -owned property associated with the
water tower for access to the site, parking, or other purposes.
5. In the event that the property is acquired by a public agency
in connection with the redevelopment of Excelsior Boulevard,
the owner and his successors agree to remove the greenhouse
without cost to the public agency, and agree that there shall
be no reimbursement for any value added to the property as a
result of greenhouse additions. The owner further agrees to
execute the agreement which contains these provisions.
