HomeMy WebLinkAbout6115 - ADMIN Resolution - City Council - 1978/09/18lir - 1 SEPTEMBER 18, 1978 lla RESOLUTION NO. 611'3 RESOLUTION ADOPTING THE MINNESOTA DEPARTMENT OF TRANSPORTATION POSITION ON THE RELOCATION COSTS OF THE SANITARY FORCE MAIN INVOLVED IN THE IMPROVEMENT OF TRUNK HIGHWAY NO. 7 FROM HIGHWAY 100 TO INGLEWOOD AVENUE WHEREAS, the Minnesota Commissioner of Transportation has prepared preliminary plans for the improvement of a part of Trunk Highway No. 7 within the corporate limits of the City of St. Louis Park from Highway 100 to Inglewood Avenue; and WHEREAS, this project has been determined to be of great benefit to the residents of St. Louis Park in terms of safety and convenience, and WHEREAS, the preliminary plans prescribe construction activities affecting the Metropolitan Waste Control Commission 24" and 30" sanitary force mains occupying the rights-of-way of Trunk Highway 7 and such occupancy is in conflict with impending highway construction; and WHEREAS, facilities placed on highway rights-of-way, subject to Minnesota Department of Transportation permits, are conditioned upon the applicant making any subsequent moves or alterations made necessary by Highway improvements at no cost whatsoever to the Minnesota Department of Transportation; and WHEREAS, the Minnesota Department of Transportation has notified the Metropolitan Waste Control Commission through a letter of notification from Mr. Joel Osendorf dated April 20, 1978 pertaining to Permit No. 5AU-70-149, Rule No. 33, Subdivision 10, Chapter 500, and WHEREAS, the delays in resolving the construction problem by the MWCC are causing indefinite delays with the implementation of the proposed improvement in St. Louis Park. Q THEREFORE BE IT RESOLVED by the City Council of St. Louis Park that the Metropolitan Waste Control Commission be requested to comply with the conditions of the Minnesota Department of Transportation permit allowing existence of a sanitary force main system in State right-of-way, BE IT FURTHER RESOLVED that the Metropolitan Waste Control Commission be encouraged to complete the specified modifications and relocation of the system in an expeditious manner in order to permit timely completion of the roadway project.
