RESOLUTION NO. 6070
RESOLUTION AUTHORIZING TAKING OF LAND BY
EMINENT DOMAIN FOR PARK PURPOSES
WHEREAS, the City Council has ordered preparation of a resolution
authorizing taking of land by eminent domain, and the City Manager has
recommended the acquisition of the land for park purposes by fee title
at the location herein specified, and it appears to the City Council
it is necessary that the City acquire such lands; therefore,
BE IT RESOLVED by the City Council of St. Louis Park:
1) It is hereby determined the taking of the parcels of land
set forth in paragraph 3 hereof is necessary for the public good in
order that said parcels shall be devoted to park use.
2) The City shall take by right of eminent domain for park
purposes the lands described in paragraph 3 hereof, and the City
-Attorney is hereby authorized and directed to commence proceedings
in the District Court of Hennepin County for appointment of Commissioners
to determine the damages, if any, sustained by the respective owner of
the parcels affected by such taking as authorized by law; and
3) The land above referred to is more particularly described as
follows:
That part of Parcel 2 lying southwest of a line drawn from the northwest corner to
a point in the easterly line 230 feet southeast of the northeast corner and westerly
of the easterly 160 feet.
2-C Parcel 2: That part of the North 1/4 of the South 1/2 of the Northeast
Quarter of the Southeast Quarter of Section 6, Township 117,
Range 21 which lies Easterly of a line drawn from a point on
the South line of said North 1/4 distant 698.7 feet East from
the Southwest corner thereof, to a point on the North line of
said Section 6, distant 863.7 feet East from the Northwest
corner of the Northeast Quarter of the Southeast Quarter of
said Section 6, according to the Government Survey thereof.
That the boundaries of Parcel 2 are marked by'Judicial Land-
marks set pursuant to Torrens Case No. 16608;
Subject to an easement for public street purposes in favor of
the City of St. Louis Park over the East 60 feet of Parcel 2
together with a cul-de-sac 120 feet in diameter at the
Northerly end thereof;
Subject to an easement in favor of the City of St. Louis Park
for ingress and egress to the adjoining land on the West over
the Southerly 60 feet of Parcel 2.
2-A Parcel 4: That part of the North 1/4 of the Northeast Quarter of the
Southeast Quarter of Section 6, Township 117, Range 21 which
lies Easterly of a line drawn from a point on the South line
of the North 1/4 of the South 1/2 of said Northeast Quarter
of the Southeast Quarter distant 698.7 feet East from the
Southwest corner thereof, to a point on the North line of
said Section 6, distant 863.7 feet East from the Northwest
corner of the Northeast Quarter of the Southeast Quarter of
said Section 6.
The boundary lines of the premises are marked by Judicial
Landmarks set pursuant to Torrens Case No. 16472;
Except that part thereof (Parcel 4) of the North 1/4 of the
Northeast Quarter of the Southeast Quarter lying Northerly
of a line drawn from the Northwest corner to a point on the
East line of said Parcel 4 distant 230 feet South from the
Northeast corner thereof.
2-B Abstract: That part of the South 1/2 of the North 1/2 of the Northeast
Quarter of the Southeast Quarter of Section 6, Township 117,
Range 21 which lies Easterly of a line drawn from a point on
the South line of the North 1/4 of the South 1/2 of said
Northeast Quarter of the Southeast Quarter distant 698.7 feet
East from the Southwest corner thereof, to a point on the
North line of said Section 6, distant 863.7 feet East from
the Northwest corner of the Northeast Quarter of the Southeast
Quarter of said Section 6.
