LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT EXPANSION OF A CLASS II RESTAURANT FOR PROPERTY LOCATED IN THE B-2 DISTRICT AT 7525 WAYZATA BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. E.M.S. Systems, Inc. has made application to the City Council for a special permit under Section 14-156(17) of the St. Louis Park Ordinance Code for the purpose of expanding a Class II•Restaurant located at 7525 Wayaata Boulevard for the legal description as follows, to -wit: The North 240 feet of the West 240 feet of the Northeast 1/4 of the Southwest 1/4 of Section 5, Township 117, Range 21, according to the United States Government Survey thereof, and situated in Hennepin County, Minnesota. Subject to road ease- ment over the West 30 feet and North 50 feet thereof. Also the East 110 feet of the South 99 feet of the North 339 feet of the West 240 feet of the Northeast 1/4 of the Southwest 1/4 of Section 5, Township 117, Range 21. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 78 -30 -SP) and the effect of the proposed expan-, sion of the Class II Restaurant on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions! the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the Class II Restaurant expansion will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed Class II Restaurant expansion is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a Class II Restaurant at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site shall be developed, used, and maintained in accordance with Exhibit A, Site Plan; Exhibit B, Landscape Plan; Exhibit C, Elevation Plan; and Exhibit D, Floor Plan, as modified by the Planning Department on May 12, 1978. g 1% 8 1 1 2. All lighting shall be shielded and directed downward so that there is no lighting tresspass onto adjacent residential property. 3. That all new construction, including landscaping, parking, new lighting, and building be completed by November 30, 1978.
