RESOLUTION NO. 6032
A RESOLUTION GRANTING PERMIT UNDER SECTION 14-141(7)(9)
OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING
TO PERMIT AN OFFICE/APARTMENT BUILDING FOR PROPERTY
LOCATED IN THE R-4 DISTRICT AT 7825 WAYZATA BOULEVARD
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Edward Wyner has made application to the City Council for a special
permit under Section 14-141(7)(9) of the St. Louis Park Ordinance Code for the
purpose of constructing an apartment/office building at 7825 Wayzata Boulevard
for the legal description as follows, to -wit:
A portion of the south one-half of Section 5, Township 117,
Range 21 and bounded by the following -described line:
Beginning at a point 205.5 feet east of the center line of
Texas Avenue and 50 feet south of the north line of said
one-half section, thence extending southerly 167.5 feet,
thence extending easterly 67.5 feet, thence northerly
parallel to the west line a distance of 167.5 feet,
thence westerly parallel with the south line a distance
of 67.5 feet to the point of beginning.
2. The City Council has considered the advice and recommendation of
the Planning Commission (Case No. 78 -47 -SP) and the effect of the proposed
apartment building/office on the health, safety and welfare of the occupants
of the surrounding lands, existing and anticipated traffic conditions, the
effect on values of properties in the surrounding area, the effect of the use
on the Comprehensive Plan, and compliance with the intent of the Zoning Ordi-
nance.
3. The Council has determined that the proposed apartment building/office
will not be detrimental to the health, safety or general welfare of the
community nor will it cause serious traffic congestion nor hazards, nor will
it seriously depreciate surrounding property values, and the proposed apartment
building/office is in harmony with the general purpose and intent of the Zoning
Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit an apartment building/office at the location
described is granted based on the findings set forth above and subject to
the following conditions:
1. That the site be developed, used, and maintained in
accordance with Exhibit A, Site Plan; Exhibit B,
Floor Plan; and Exhibit C, Elevation Plan.
2. That the garage or accessory structure be demolished.
3. That the use be for three apartment units and one
office or four apartments to allow the applicant
to convert the office area to an apartment without
requiring submission of a new application.
4. That the parking to be deeded from the abutting
property owner be completed in a form acceptable
to the City prior to the issuance of a building
permit.
5. That all development, landscaping, and parking
area be completed by October 1, 1980.
6. That there shall be no storage of material on
the site, no retailing from the site, or no
manufacturing or processing on the site.
7. That all development, landscaping, and parking
area be completed by August 1, 1980.
