HomeMy WebLinkAbout6015 - ADMIN Resolution - City Council - 1978/05/15OC 1 May 15, 1978 8c RESOLUTION NO. 6015 A RESOLUTION GRANTING PERMIT UNDER SECTION 14-124.101 OF THE ZONING ORDINANCE TO PERMIT THE USE OF A DRIVE -UP WINDOW WITH AUXILIARY SIGNING FOR PROPERTY LOCATED IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT, AT 5001 EXCELSIOR BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. B. Dalton Bookseller has made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordi- nance Code for the purpose of permitting a drive -up window with auxiliary signing located at 5001 Excelsior Boulevard for the legal description as follows, to -wit: Commencing from the center line of Excelsior Boulevard 901 feet northeasterly from its intersection with the center line of Wooddale Avenue, then at right angles southeasterly 350 feet, then southwesterly 70 feet parallel with Excelsior Boulevard, then northwesterly 350 feet to the point in the center line of Excelsior Boulevard, a distance of 70 feet from the point of beginning. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 78 -15 -SP) and the effect of the proposed drive -up facility on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed drive -up facility will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed drive -up facility is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a drive -up window at the location described is granted based on the findings set forth above and subject to the • following conditions: 1. The special permit is granted for a period of one year expiring on May 15, 1979. 2. Parking stalls shall have a minimum dimension of 9 feet by 20 feet and not less than 27 parking spaces shall be provided on the site. The parking area shall be striped.
