RESOLUTION NO. 6010
RESOLUTION AUTHORIZING TAKING OF LAND BY EMINENT
DOMAIN FOR STREET, RIGHT-OF-WAY AND UTILITY
USE
WHEREAS, the City Council has ordered preparation of a resolution
authorizing taking of land by eminent domain,and the City Engineer has
recommended the acquisiiton of land for street, right-of-way and utility
purposes by fee title at the locations hereinafter specified, and it appears
to the Council that it is necessary that the City acquire such lands; there-
fore,
BE IT RESOLVED by the City Council of St. Louis Park:
1) It is hereby determined the taking of each of the tracts and
parcels of land set forth in paragraph 3 hereof is necessary for the public
good in order that said tracts and parcels shall be devoted to street,
right-of-way and utility use.
2) The City shall take by right of eminent domain for street,
right-of-way and utility purposes the lands described in paragraph 3 hereof,
and the City Attorney is hereby authorized and directed to commence pro-
ceedings in the District Court of Hennepin County for appointment of Com-
missioners to determine the damages, if any, sustained by the respective
owner of the parcels affected by such taking, as authorized by law, and
3) The lands above referred to are more particularly described as
all that part of the following described Tract 1 and Tract 2:
Tract 1
The west 190 feet of that part of the northwest quarter of the
southwest quarter lying east of the West 40 feet and north of
a line bearing north 88 degrees 29 feet 58 seconds east from
a point to the west line of the northwest quarter of the south-
west quarter distant 268.05 feet south of the northwest corner
of said northwest quarter of the southwest quarter, Section 30,
Township 29, Range 24. For purpose of this description, the
west line of said northwest quarter of the southwest quarter is
assumed to bear due north and south.
Tract 2
That part of the northwest quarter of the southwest quarter
lying west of the east 20.87 acres thereof, except the west 40
feet of said tract, in Section 30, Township 29, Range 24,

hereinafter called "the above-described property," lying
north of the following described line; commencing at the south-
east corner of the above-described property; thence north along
the east line of the above-described property 705.21 feet to
the point of beginning of the line to be described; thence at
a right angle west to the west line of the above-described
property and there terminating, except the south 76.46 feet
thereof, and except that part of the west 190 feet of the above-
described property lying north of a line bearing north 88
degrees 29 minutes 58 seconds east from a point in the west
line of said northwest quarter of the southwest quarter,
distant 268.05 feet south of the northwest corner of said
northwest Quarter of the southwest quarter. For the purpose of
this description, the west line of said northwest quarter of
the southwest quarter is assumed to bear due north and south,
which lies northerly and westerly of Line A, described below:
Line A
Beginning at a point on the west line of the southwest quarter of
Section 30, Township 29, Range 24, Hennepin County, Minnesota,
distant 457.03 feet south from the west quarter corner of said
Section 30; thence easterly 50.00 feet at right angles to said west
line; thence northeasterly 182.21 feet on a tangential curve con-
cave to the northwest, radius 116.00 feet, through a central angle
of 90 degrees 00 minutes 00 seconds; thence northerly 164.90 feet
tangent to said curve; thence northeasterly 129.88 feet on a
tangential curve, concave to the southeast, radius 64.00 feet,
through a central angle of 88 degrees 35 minutes 33 seconds; thence
northerly,normal to last said curve, to the north line of the south-
west quarter of said Section 30, and there terminating.
Together with that part of Tract 2 which lies northwesterly of the following
described line:
Commencing at a point on Line A distant 40.00 feet east from the
point of beginning of Line A; thence southerly 25.00 feet, at ,
right angles to Line A, to the beginning of the line herein
described; thence northeasterly to a point on Line A distant
65.00 feet east from the point of beginning of Line A, and there
terminating.
Together with a temporary construction easement over that part of Tracts 1
and 2 contained within a 10.00 -foot -wide strip; the northerly and westerly
line of said strip is coincident with Line A.
