RESOLUTION NO. 6005
RESOLUTION GIVING APPROVAL FOR FINAL PLAT OF
ZARTHAN PARK
BE IT RESOLVED BY the City Council of St. Louis Park:
Findings
1. First Lutheran Church and Boran Builders, Inc., owners and sub-
dividers of the land proposed to be platted as Zarthan Park, have submitted
an application for approval of final plat of said subdivision in the manner
required for platting of land under the St. Louis Park Ordinance Code, and
all proceedings have been duly had thereunder.
2. The proposed final plat has been found to be in all respects consistent
with the City Plan and the regulations and requirements of the laws of the State
of Minnesota and the ordinances of the City of St. Louis Park.
3. The proposed plat is situated upon the following described lands in
Hennepin County, Minnesota, to -wit:
Lots 1 and 2, Auditor's Subdivision 323; Lot 28, Auditor's
Subdivision 323; except the west 46' of Lot 28 lying east of
Lot 27 in Auditor's Subdivision 323; that part of Lot 26, Auditor's
Subdivision 323 lying northerly of a line described as follows:
Beginning at a point in the west line of said Lot 26, distant
65 feet north of the southwest corner thereof; thence east parallel
with the north line of said Lot 26 to the east line thereof and
there terminating; except that part thereof lying westerly of the
following described line: Beginning at a point in the north line
of said Lot 26, distant 200 feet easterly, measured along said
north line, from the east line of Zarthan Avenue; thence south
parallel with the east line of said avenue to the south line of
the above described tract.
Conclusion
1. The proposed final plat of Zarthan Park
and accepted by the City as being in accord and conformity with all ordinances,
City plans and regulations of the City of St. Louis Park and the laws of the
State of Minnesota, subject to the following conditions:
1. The site shall be graded in accordance with the Grading, Drainage,
and Utility Plan prepared by Egan, Field, and Nowak Inc. as revised
April 17, 1978.
2. Sanitary sewer and water lines shall be provided separately to each
lot except for Lot 1, Block 1, and Lot 1, Block 6.
3. The site shall be developed, used, and maintained in accordance
with Resolution No. 5984 adopted by the City Council on April 3, 1978.
4. The subdivision improvements shall be completed by September 1, 1979,
in accordance with Resolution No. 5984.
provided, however, that this approval is made subject to Certification by the
City Clerk as provided for in Section 14-303(3)(e) of the St. Louis Park
Ordinance Code.
2. The City Clerk is hereby directed to file a certified copy of this
Resolution in the office of the Register of Deeds and Registrar of Titles for
their use as required by M.S.A. 471.29.
3. The City Clerk is hereby directed to supply a certified copy of this
Resolution to the above-named owner and subdivider, who is the applicant herein.
4. The Mayor and City Manager are hereby authorized to execute all contracts
required herein, and the City Clerk is hereby directed to execute the certificate
of approval on behalf of the City Council upon the said plat when all of the con-
ditions set forth in paragraph no. 1 above and Section 14-303(3)(e) of the St.
Louis Park Ordinance Code have been fulfilled.
5. Such execution of the certificate upon said plat by the City Clerk, as
required under Section 14-303(3)(e), shall be conclusive showing of proper com-
pliance therewith by the subdivider and City officials charged with duties above
described and shall entitle such plat to be placed of record forthwith without
further formality.
