LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT CONSTRUCTION OF A SINGLE FAMILY HOME IN THE F-2 FLOOD PLAIN DISTRICT AND R-1 SINGLE FAMILY DISTRICT FOR PROPERTY LOCATED AT 8301, 8305, 8309, 8313, 8317, 8321, 8325, 8329, and 8333 W. FRANKLIN AVENUE. BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. McNulty Construction Co. and Arnold Stern have made application to the City Council for a special permit under Section 14-123.100 of the St. Louis Park Ordinance Code for the purpose of permitting construction of single family homes in the F-2 Flood Plain District located at 8301, 8305, 8309, 8313, 8317, 8321, 8325, 8329, and 8333 W. Franklin Avenue for the legal description as follows, to -wit: Lots 1 through 9, Block 1, Westwood Estates 4th Addition 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 78 -21 -SP) and the effect of the proposed construc- tion of single family homes in the F-2 Flood Plain District on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, compliance with the intent of the Zoning Ordinance, and compliance with the requirements of the F-2 District relating to the flood protection elevation. 3. The Council has determined that the construction of single family homes in the F-2 District will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed construction of single family homes in the F-2 District is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan and is in compliance with the requirements of the F-2 District relating to flood protection elevation. Conclusion The special permit to permit the construction of single family homes in the F-2 District at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The lowest floor elevation of any structure shall be at or above 891 feet M.S.L. and the subdivision conditions of Westwood Estates 4th Addition requiring the lowest floor elevation to be not less than 893 feet M.S.L. is hereby amended to read 891 feet M.S.L.
