RESOLUTION NO. 5984
A RESOLUTION GRANTING PERMIT UNDER SECTION 14-131(1) AND
SECTION 14-146(5) OF THE ST. LOUIS PARK ORDINANCE CODE
RELATING TO ZONING TO PERMIT A SIXTEEN UNIT CLUSTER
HOUSING DEVELOPMENT FOR PROPERTY LOCATED IN THE R -B
RESIDENCE BUSINESS DISTRICT AND R-2 RESIDENCE DISTRICT
AT 3051 to 3081 ZARTHAN AVENUE SOUTH.
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. W.A. Boran has made application to the City Council for a special
permit under Section 14-131(1) and Section 14-146(5) of the St. Louis Park
Ordinance Code for the purpose of permitting a sixteen unit cluster housing
development located at 3051 through 3081 Zarthan Avenue South for the legal
description as follows, to -wit:
Lots 1 and 2, Auditor's Subdivision 323; Lot 28, Auditor's
Subdivision 323; except the west 46' of Lot 28 lying east of
Lot 27 in Auditor's Subdivision 323; that part of Lot 26,
Auditor's Subdivision 323 lying northerly of a line described
as follows: Beginning at a point in the west line of said
Lot 26, distant 65 feet north of the southwest corner thereof;
thence east parallel with the north line of said Lot 26 to the
east line thereof and there terminating; except that part thereof
lying westerly of the following described line: Beginning at a
point in the north line of said Lot 26, distant 200 feet easterly,
measured along said north line, from the east line of Zarthan
Avenue; thence south parallel with the east line of said avenue
to the south line of the above described tract.
2. The City Council has considered the advice and recommendation of
the Planning Commission (Case No. 78 -4 -SP) and the effect of the proposed
sixteen unit cluster housing development on the health, safety, and welfare
of the,occupants of the surrounding lands, existing and anticipated traffic
conditions, the effect on values of properties in the surrounding area, the
effect of the use on the Comprehensive Plan, and compliance with the intent
of the Zoning Ordinance.
3. The Council has determined that the proposed sixteen unit cluster
housing development will not be detrimental to the health, -safety, or general
welfare of the community nor will it cause serious traffic congestion nor
will it seriously depreciate surrounding property values, and the proposed
sixteen unit cluster housing development is in harmony with the general
purpose and intent of the Zoning Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit a sixteen unit cluster housing development at
the location described is granted based on the findings set forth above
and subject to the following conditions:
1. The site shall be developed, used, and maintained in accordance
with Exhibit A, Site Plan/Landscape Plan; Exhibit B, Unit Floor
Plans; Exhibit C, Unit Elevation Plans; and Exhibit D, Front
and Rear Building Elevation Plans.
2. The access road and the 24' wide roadway through the develop-
ment, including the cul-de-sac, shall be designated as a fire
lane.
3. Fire detection devices shall be installed in the garages with
a device actuating the detector in the living area.
4. Entry doors shall be provided with a dead bolt lock with a
one inch throw.
5. All construction, paving, landscaping, usable open space
improvements improvements, and utilities shall be completed
by September 1, 1979.
